HomeMy WebLinkAboutOrdinance 11127J ORDINANCE N0. ~~ AN ORDINANCE AMENDING ORDINANCE N0. 11088 VACATING, ABANDONING, AND CLOSING AND EXTINGUISHING A PORTION OF HASLET-ROANOKE ROAD BY DELETING A PORTION OF SECTION 2 WHICH PROVIDED FOR THE RETENTION OF A UTILITY EASEMENT; REPEALING ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 2 of Ordinance No. 11088, adopted by the City Council on May 5, 1992, is hereby amended to delete the following clause: "...save and except that easements are retained for any and all existing and prospective utilities.", so that Section 2, as amended, shall hereafter read as follows: "That the fee to the land in the above described vacated street right-of-way is hereby released and shall revert to the adjacent owner as provided by law." The purpose of this amendment is to provide for the vacation, abandonment, closing and extinguishing of the street right-of-way described in Ordinance No. 11088, consisting of a portion of Haslet-Roanoke Road, without the retention of a utility easement by ordinance. SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. Pj SECTION 3. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. It is further recommended that the City Council approve the attached ordinance amending Ordinance 11088. DISCUSSION: Hillwood Development Corporation has submitted the final plat and dedication instruments for the construction of Eagle Parkway and Westport Parkway, as well as all utilities necessary for the Phase I development of Alliance Gateway Addition. The regional Nestle Distribution Center construction can begin following the filing of the plat and dedication deeds and the formal real estate closing. On May 5, 1992, the City Council approved Ordinance 11088, which abandoned and vacated Haslet-Roanoke Road. The ordinance, as approved, contains standard language which reserves the right to install prospectively utilities if necessary in the vacated right-of-way. The vacated portion of Haslet-Roanoke Road is approximate center of the planned Nestle facility and obviously, no future utility installation in this vacated right-of-way is contemplated. The amendment simply deletes the "save and except" language from Ordinance 11088. FISCAL INFORMATION/CERTIFICATION: This action by the City Council does not require expenditure of City funds.
