HomeMy WebLinkAboutOrdinance 11229 F ;: 51 + S t ' ORDINANCE NO. / /~~~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING AN ALLEY RIGHT-OF-WAY, AN EMERGENCY ACCESS EASEMENT AND A UTILITY EASEMENT LOCATED WITHIN THE GRANDVIEW ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: ~, SECTION 1. THAT the ten ( 10 ) foot wide by approximately two hundred fifty (250) foot long alley right-of-way located between Lots 1 through 6 and 7-R and Lots 20 through 29, the fifteen (15) foot wide emer- gency access easement located in Lot 7-R, and the five (5) foot wide utility easement located along the west property line of Lot 7-R, adjacent to Lot 6, Block 4, Grandview Addition, as recorded in Volume 63, Page 29, and Volume 388-206, Page 80, P.R.T.C.T., and as more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same are vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated alley right-of-way, emergency access easement and utility easement is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that the west one hundred ten (110) feet of the alley right-of-way is retained as a utility easement for any and all existing and prospective utilities. r-______ O~F1ClAl ld~CO~Q clr~r sE~~~~ SECTION 3. DISCUSSION: Mr. James Dunaway, consultant, on behalf of Cook Fort Worth Children's Medical Center, owner of all adjacent property, has requested that the City vacate the above described alley, access easement, and utility easement (attached map and field notes) This utility easement and access easement contain no utility facilities. The alley contains an electric service line. Appropriate adjustments will be made to this line in order to accommodate this request. Reviewing City Departments and Private Utility Companies have raised no objections to this request. A satisfactory replat have been submitted. This request is located in COUNCIL DISTRICT Pdo. 9 FISCAL INFORMATION: The Land Agent for the City of Fort Worth has determined that a $17,430.00 fee satisfies the interest of the City of Fort Worth in the vacation of this alley right- of-way, access easement and utility easement.
