.~ r ORDINANCE NO. ~/~ ~, AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTINGUISHING A PORTION OF A STREET RIGHT-OF-WAY AND A PORTION OF AN ALLEY RIGHT-OF-WAY LOCATED WITHIN THE HYDE JENNI~NGS SUBDIVISION OF THE JENNINGS SOUTH ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND: REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE iCITY OF FORT WORTH, TEXAS: SECTION 1. THAT the remaining portion of the street right-of-way of West Broadway Street located between Blocks 25 and 30 and the remaining portion of the north-south alley right-of-way, save and except the south one hundred three point zero six (103.6) feet, located in Block 30, between Lots 1 through 6 and Lots it through 16, Hyde Jennings Subdivision of the Jennings South Addition, as recorded in Volume lOb, Page 62, P.R.T.C.T_, and as more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same are vacated, abandoned and permanently closed and extinguished. SECTION 2. THAT the fee to the land in the above described vacated street right-of-way and alley right-of-way is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities_ O~~~CC~[ ~~CORD C6~9~ SEC~~~1~Y ~~. ~NC~ ~H, t~X. SECTION 3_ THAT all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. THAT this ordinance shall take effect and be in full force and effect from and after the date of its passages and it is so ordained. DISCUSSION: Mr. George Bruckman, attorney representing Dannon Company, has requested that the City vacate the above-described street and alley rights-of-way for the development of an d industrial facility. The street and alley rights-of-way contain utility facilities an t th e acceptable arrangements have been made for the relocation of these facilities a applicant's expense. Reviewing City departments and private utility companies have raised no objections to this request. An acceptable replat has been submitted. This request is located in COUNCIL DISTRICT 8. FISCAL INFORMATION/CERTIFICATION: based on the nature of the project, that a one-dollar fee will It has been determined , satisfy the interest of the City of Fort Worth in these public rights-of-way and will compensate the City for the transfer of said rights-of-way.
