HomeMy WebLinkAboutOrdinance 11147~~, ~~ ,~ ~ s t ~Ci" ~ mar= ORDINANCE NO 1~~~-/ f-~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $25,000 00 FOR THE PURPOSE OF FUNDING A LOAN SERVICING POSITION, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1991-92 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund fri the amount of $25,000 00 for the purpose of funding a loan servicing position in the Housing and Human Services Department. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or udgment shall in no way impair the remaining portions, sections, or parts of sections ofjthis ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 10892 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. City Manager to transfer $25,000 00 from the Commercial'~Deire"~iopment Revolving Loan Fund Income Account to the Housing and Human Services Department in the Grants Fund for a loan servicing position, and 2 Adopt the attached supplemental appropriations ordinance increasing estimated receipts and appropriations by $25,000 00 in the Grants Fund from increased revenues DISCUSSION On June 9, 1992, the City Council considered M&C C-13406, which would have established an agreement between the Internal Audit Department and the Housing and Human Services Department for the assignment of an employee in the Internal Audit Department for servicing of the City's Commercial Development Revolving Loan (RLF) Program The M&C was tabled pending further review and consideration by the City Council`s Audit Committee At its meeting of June 16, 1992, the Audit Committee expressed concern that the assignment of an employee from the Internal Audit Department to provide servicing and monitoring of the RLF Loans was inappropriate The Committee's concern was that serious questions could arise if the Internal Audit Department were placed in the position of having to monitor and audit itself Consequently, the Fiscal Services Department or the Housing and Human Services Department were mentioned as possible locations for the RLF loan monitoring and servicing activities. Council then directed staff to determine which department was better suited to house the RLF loan servicing position Staff from both the Fiscal Services Department and the Housing and Human Services Department met and decided that the position should be assigned to the Housing and Human Services Department The decision was based primarily on the fact that the Housing and; Human Services Department is responsible to both the U S Department of Housiri'g and Urban Development (HUD) and the U 5 Department of Commerce, Economic Developmeht Administration {EDA) for ensuring that proper documentation and records are maintained on the RLF Program's expenditures and activities j' ~ At the Council meeting of June 23, 1992, the City Council agreed to accept the recommendation of Council Member Eugene McCray, Chairman of the Audit Committee, that M&C C-13406 be denied .. ., ,;i - ,, .. .~ ~t~~t~ Ci~y~w of~Fort worth;.
