HomeMy WebLinkAboutOrdinance 11048ORDINANCE N0. ~l D~f AN ORDINANCE SPECIFYING THE ADJUSTED TOTAL NUMBER OF AUTHORIZED CIVIL SERVICE POSITIONS AT EACH RANK IN THE FIRE DEPARTMENT; ADDING THREE FIREFIGHTER POSITIONS TO THE TOTAL AUTHORIZED STAFFING; ADDING ONE ENGINEER POSITION TO THE TOTAL AUTHORIZED STAFFING; PROVIDING THE STATEMENT OF INTENT TO DELETE TWO CAPTAIN AND ONE LIEUTENANT POSITIONS AT A LATER DATE FROM THE TOTAL AUTHORIZED STAFFING; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. BE IT HEREBY KNOWN: WHEREAS, the Fire Chief has requested the City Council to readjust and thereafter specify the total authorized number of positions at each rank in the Fire Department for the remainder of the 1991-1992 Fiscal Year; and WHEREAS, the City's Appropriation Ordinance for the Fiscal Year 1991-1992, the most recent ordinance concerning the authorized and budgeted positions for the Fire Department, adjusted the department's civil service staffing, as follows: Deputy Chiefs 6 Battalion Chiefs 17 Captains 7b* Lieutenants 98** Engineers 156*** Firefighters 308 TOTAL 661 * Includes two overage positions to be deleted. ** Includes one overage position to be deleted. *** Includes two overage positions to be deleted. Included in the same appropriations ordinance was also the Council's statement of intent that five civil service positions consisting of two engineer positions, one lieutenant position and two captain positions were to be deleted from the Fire Department during the fiscal year as attrition occurs, which would result in a new authorized strength of 656 authorized positions as follows: 308 firefighters, 154 engineers, 97 lieutenants, 74 captains, 17 battalion chiefs and 6 deputy chiefs; and WHEREAS, subsequent to the enactment of said Appropriations Ordinance, litigation involving Fire Department staffing and duties concerning the City's Meacham Airport Aircraft Crash and Rescue operations was concluded resulting a court judgment requiring said crash and rescue operations to thereafter be performed by the City's Fire Department rather than the existing Aviation Department's non-civil service personnel; and WHEREAS, other positions in the Fire Department have become vacant due to employee retirement, illness or involuntary termina- tions; and WHEREAS, the Chief of the Fire Department naw requests that the Council adjust the authorized number of Fire Department civil service positions as set forth immediately below in order to effect efficient economy of the operations of the City's municipal ser- vices; and WHEREAS, the specification and authorization of the correct number of budgeted civil service positions is now a necessity; NOW, THEREFORE, 2 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That, effective as of the date of adoption of this ordinance, the following positions are the only civil service positions autho- rized in the City of Fort worth Fire Department for the remainder of the fiscal year 1991-1992: Deputy Chiefs g Battalion Chiefs 17 Captains 76* Lieutenants g$** Engineers 157*** Firefighters 311**** TOTAL 665 * Includes two captain positions to be deleted upon the next vacancies ** Includes one lieutenant position to be deleted upon the next vacancies *** Includes two engineer positions which were previously intended to be deleted plus one new additional position **** Increase in three new firefighter positions to be filled from the next academy class SECTION 2 The City Council hereby expresses its intent to delete certain positions within the Fire Department, meaning that from time to time and as normal attrition from the department occurs, certain positions being occupied by civil service personnel will be removed from the classified service by ordinance Those positions to iae deleted include two (2) Captain positions and one (1) Lieutenant 3 position, thus resulting in a total of 662 authorized civil service positions in the Fire Department. This expression of intent to delete said positions upon the occurrence of the appropriate vacan- cies is provided so as to negate any expectation of promotion opportunity at said ranks until after said positions have been deleted. SECTION 3 This ordinance shall be cumulative of a-11 provisions of pre- vious ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this staffing ordinance are in direct conflict with the provisions of such ordi- nances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. The "Mayor and Council Communication" memorandum contemporan- eous with this ordinance is hereby expressly incorporated herein by reference as if repeated verbatim in this paragraph for further clarification and explanation of the purpose and intent of the Council in its adoption of this ordinance. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconsti- tutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of 4 this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5 The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date in the minutes of the City Council and by filing the ordinance in the ordinance records of the City of Fort Worth, Texas. SECTION 6. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained.
