AN ORDINANCE AMENDING SECTIONS IS-4 AND 18-5 OF THE CODE OF THE CITY
OF FORT WORTH (1986), AS AMENDED, BY REQUIRING LAKE WORTH USE FEES;
BY REQUIRING LAKE WORTH USE FEE PERMITS; MAKING THIS ORDINANCE
CUMULATIVE AND REPEALING ALL CODE SECTIONS AND ORDINANCES IN
CONFLICT HEREWITH; PROVIDING A SF_VERABILITY CLAUSE; PROVIDING A
PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR
PUBLICATION AS REQUIRED BY LAW, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS=
SECTION 1.
That Section 18-4 of Article T (In General) of Chapter 18 (Lake Worth)
of the Code of the City of Fort Worth (1986), as amended, be amended and as
amended shall read as follows

it shall be unlawful to operate or place any boat on Lake Worth without
paying the required use fee, Annual use fees shall be valid from the date
issued until December 31 of the year issued The fees shall be

(b) A watercraft dealer Lake Worth use fee p ermit for the sole purpose of
demonstrating watercraft for sa le may be issued by the City The permit
shall be valid from the date issued until December 31 of the year issued
The fee shall be X75.00
SECTION 2.
That Section 18-5 of Article I (In General) of Chapter 18 (Lake Worth)
of the Code of the City of Fort Worth (1986), as amended, be amended and as
amended shall read as follows
Section ]8-5 Lake Worth Use Fee Permit
(a) It shall be unlawful for any person to operate or for a person in control
to allow another person to operate either (1) a motor- or power-driven
boat less than sixteen (lb) feet in length, or (2) a boat sixteen (16)
feet or more in length, on Lake Worth without a valid Lake Worth Use Fee
Permit
(b) An annual Lake Worth Use Fee Permit is valid if it is for the current
year and is affixed to the boat for which it is issued on the left side
of the transom above the water line in a clearly visible location
(c) A temporary Lake Worth Use Fee Permit is valid if it is for the current
date and not expired, and is in the possession of the person operating
the boat for which it is issued, and is shown upon the request of any
peace officer or lake officer
(d) A watercraft dealer Lake Worth Use Fee Permit is valid if it is for the
current year, and the watercraft is being used only for the purpose of
demonstrating it for sale, and the permit is in possession of the person
demonstrating the watercraft, and the permit is shown upon the request of
any peace officer or lake officer
SECTION 3.
This ordinance shall be cumulative of all provisions of ordinances and of
the Code of the City of Fort Worth, Texas (1986), as amended, except where the
provisions of this ordinance are in direct conflict with the provisions of
such ordinances and such Code, in which event conflicting provisions of such
ordinances and such Code are hereby repealed
SECTION 4.
It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses and phrases of this ordinance are
severable, and if any phrase, clause, sentence, paragraph or section of this
ordinance shall be declared unconstitutional by the valid judgment or decree
of any court of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section
SECTION 5.
Any person, firm or corporation who violates, disobeys, omits, neglects
or refuses to comply with or who resists the enforcement of any of the
provisions of this ordinance shall be fined not more than five hundred
dollars (500 00) for each offense Each day that a violation is permitted to
exist shall constitute a separate offense
SECTION 6
All rights and remedies of the City of Fort Worth, Texas, are expressly
saved as to any and all violations of the provisions of Chapter 18 or any
other ordinances affecting Lake Worth which have accrued at the time of the
effective date of this ordinance, and, as to such accrued violations and all
pending litigation, both civil and criminal, whether pending in court or not,
under such ordinances, same shall not be affected by this ordinance but may be
prosecuted until final disposition by the courts
SECTION 7.
The City Secretary of the City of Fort Worth, Texas, is hereby directed
to publish the caption, penalty clause and effective date of this ordinance
for two (2) days in the official newspaper of the City of Fort Worth, Texas,
as authorized by Section 52 013, Texas Local Government Code.
SECTION 8.
This ordinance shall be in full force and effect from and after its
passage and publication as required by law, and it is so ordained

It is recommended that the City Council approve the adoption of th e attached-~6rdinance
that amends Sections 18-4 and 18-5 of Chapter 18 (Lake Worth) of the Code of•the City
of Fort Worth.
DISCUSSION
The attached ordinance implements a temporary Lake Worth Use Fee for persons who are
one time users of the lake, and implements a Watercraft Dealers' Permit Fee.
