AN ORDINANCE APPROPRIATING 535,000 00 TO T?~E
WATEk AND WASTEWATER OPERATING FUND AND
DECREASING THE UNRESTRICTED, UNDESIGNATED
RETAINED EARNINGS BY THE SAME AMOUNT FOR THE
PURPOSE OF PAYING FEES TO THE TEXAS WATER
COMMISSION FOR THE PURPOSE OF ASSESSING WATER
QUALITY IN THE TRINITY RIVER BASIN, PROVIDING
FOR A SEVERABILITY CLAUSE, MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND
REPEALING ALL PRIOR ORDINANCES IN CONFLICT
HEREWITH, PROVIDING FOR ENGROSSMENT AND
ENROLLMENT, AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS
SECTION 1
That in addition to those amounts allocated to the various City
departments for the Fiscal Year 1991-92 and in the Budget of the
City Manager, there shall also be increased appropriations in the
Water and Wastewater Operating Fund in the amount of $35,000 00
thereby decreasing the unrestricted, undesignated Retained
Earnings by the same amount for the purpose of paying the annual
water quality assessment fee to the Texas Water Commission for
administering water quality management programs in the Trinity
River basin
SECTION 2
Should any portion, section or part of a section of this
ordinance be declared invalid, inoperative or void for any reason
by a court of competent jurisdiction, such decision, opinion or
judgement shall in no way impair the remaining portions, sections
or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect
SECTION 3
This ordinance shall be cumulative of Ordinance No 10892 and all
other ordinances and appropriations amending the same except in
those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in
which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed

SECTION 4
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption i.n
the minutes of the City Council and by filing the ordinance in
the ordinance records of the City of Fort Worth.
SECTION 5
This ordinance shall take effect and be in full force and effect
from and after the date of its passage, and it is so ordained

SUBJECT WATER UALITY ASSESSMENT BY WATERSHED
RECOMMENDATIbN:
It is recommended that the City Council:
1. Authorize the payment of $35,000.00 to the Texas Water Commission for the annual
fees for water quality management, and
2. Adopt the attached supplemental appropriation ordinance increasing the Water and
Sewer appropriation by $35,000.00 and decreasing the Unreserved, tfndesignated
Water and Sewer Operating Fund retained earnings by the same amount.
DISCUSSION:
Senate Bill 818 requiring implementation of a program for orater quality assessment by
watershed was passed during the last legislative session. The program is to be
conducted by existing river basin authorities, and includes assessment of water quality
every two years. The Trinity River Authority of Texas will perform the assessment in
the Trinity River basin. The Senate bill authorized the Texas Water Commission (TWC)
to recover the reasonable costs of administering the water quality management programs
from all users of water and wastewater permit holders in each watershed generally in
proportion to their right to use water from and discharge wastewater into the
watershed.
These annual fees are based on the operating parameters specified in the wastewater
permits for flow and traditional pollutant limits. The fees are due each January 1 and
assessed a penalty of 10% if not received by March 31. The maximum fee charged per
facility is $35,000.00.
FISCAL INFORMATION/CERTIFICATION:
The Director of Fiscal Services certifies that, upon adoption of the supplemental
appropriation ordinance, funds required for this expenditure will be available in the
Water and Sewer Operating Fund.
