AN ORDINANCE AMENDING SECTION 35-56 (b),
SECTION 35-56 (g) OF CHAPTER 35 OF THE CODE OF
THE CITY OF FORT WORTH (1986), AS AMENDED,
REVISING CERTAIN RATES AND CHARGES; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;
REPEALING ALL ORDINANCES AND PROVISIONS OF THE
FORT WORTH CITY CODE IN CONFLICT HEREWITH;
PROVIDING A SAVINGS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
SECTION 1.
That Section 35-56 (b) of Chapter 35 of the Code of
the City of Fort Worth (1986), as amended, be and the
same is hereby amended and, after having been amended,
shall be read as follows:
"(b) The following schedule of rates per month, or
fraction thereof , shall be the charges to all residential
and nonresidential customers for furnishing water to such
customer located within the city. The residential
monthly volume charge for water service shall be the
charges to the residential customer class, as defined in
this chapter, for furnishing water to residential water
customers located within the city. The nonresidential
monthly volume charge for water service shall be the
charges to the nonresidential customer class, as defined
in this chapter, for furnishing water to nonresidential
water customers located within the city."

The monthly volume charge for water service is as
follows:

The service charges set out in the foregoing schedule are
based upon the amount of water used as measured by
meters.
SECTION 2.
That Section 35-56 (g) of Chapter 35 of the Code of
the City of Fort Worth (1986), as amended, be and the
same is hereby amended and, after having been amended,
shall be and read as follows:
"(g) The following schedule of rates per month, or
fraction thereof, shall be the charges to all wholesale
customers for furnishing water to such customers.

SECTION 3
This ordinance shall be cumulative of all provisions
of ordinances and of the Code of the City of Fort Worth,
Texas (1986), as amended, except where the provisions of
this ordinance are in direct conflict with the provisions
of such ordinances and such Code, in which event
conflicting provisions of such ordinances and such Code
are hereby repealed.

SECTION 4.
It is hereby declared to be the intention of the
City Council that the sections, paragraphs, sentences,
clauses and phrases of this ordinance are severable, and
if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared unconstitutional by the
valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same
would have been enacted by the City Council without the
incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 5.
That this ordinance shall become effective and be
in full force and effect from and after its passage;
provided, however, that the increased rates specified
herein shall apply to residential, nonresidential, and
wholesale utility statements sent by the City of Fort
Worth on or after November 1, 1992, and it is so
ordained.

SUBJECT 1992 PROPOSED WHOLESALE AND RAW WATER RATES
RECOMMENDATION:
It is recommended that the City Council approve the attached ordinance which revises
the wholesale water rates and the rates for raw water.
DISCUSSION:
Wholesale water rates:
For FY 1993 rates,. Water Department staff conducted a wholesale water rate study that
indicates the following rates will recover the costs of providing wholesale water
service. A joint meeting of the Wholesale Water and Wastewater Advisory Committees was
held July 28, 1992, to present the study and the rate requirements.

Raw water rates:
The cost of untreated water supplied to Fort Worth by the Tarrant County Water Control
and Improvement District No. 1 is $0.5647 per thousand gallons for use inside the
District and $0.6457 per thousand gallons outside the District. Adjusted for street
rental and system loss, the raw water charge to customers is $0.6108 per thousand
gallons inside the District and $0.6984 per thousand gallons outside and is a direct
"pass through" to the wholesale customers.
FISCAL INFORMATION/CERTIFICATION:
Adoption of this ordinance will not create any additional expenditure. Water Customer
Service is responsible for collecting revenue to the City under the new rates.
