HIGHWAY �4• 80 WEST, EAST OF CIMARRON TRAIL, BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EF- FECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described portion of right of way on the east side of Cimarron Trail and on the south side of U. S. Highway 80, being a strip of land 175 feet by 45 feet, is here- by closed, abandoned and permanently vacated as right of way for a street or public thoroughfare of any kind or character whatever, save and except that an easement is retained for storm drain purposes in connection with the extension of the storm drain located in Cimarron Trail: Beginning at a point in the easterly right of way line of Cimarron Trail, as realigned, said point also being in the north property line of Tract A, Block 1, Western Hills, Section Two, as filed in Vol. 388-6, page 92, of the Plat Records of Tarrant County, Texas; thence east along the north line of said Tract A, which also is the south line of dedication for a Service Street to U. S. High- way 80, a distance of 188 feet more or less to a point for corner; thence north along a straight line a distance of 45 feet to a point for corner; thence west along a straight line 45 feet north of and parallel to the north line of said Tract A to a point in the easterly right of way line of realigned Cimarron Trail, a distance of 175 feet; thence southerly along the easterly line of realigned Cimarron Trail to the point of beginning. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said strip is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. S. Highway 80 West and. Ci.naaron Trail has requested the closing of a portion of the right-of-way 175 ft. by 45 ft. a9 shown on the attached map. The private utility companies have been advised of the request and have no objection to the proposed closing. The Texas Highway Department, in a letter dated .dune 10, 1963, declared that it exercises no jurisdiction over the subject right-of-way, and therefore has no objection to the proposed closing. The Public Works, Traffic Engir eering and Plaming Departments agree that closing this portion of right-of-a*ay is desirable and is in accordance with plans for service roads and other improvements in the area. The Water Department does not object to the proposed closing. The City plan Commission in session May 8, 1963, reviewed the request and recom- mended that this section of road he closed, and that the City Council adopt an ordinance closing the subject right-of-way as requested.
