ORDINANCE N0.
AN ORDINANCE SPECIFYING THE ADJUSTED TOTAL NUMBER OF
AUTHORIZED CIVIL SERVICE POSITIONS AT EACH CLASSIFICA-
TION (RANK) IN THE FIRE DEPARTMENT AS OF THE BEGINNING
OF FISCAL YEAR 1992-1993; .PROVIDING THE STATEMENT OF
INTENT TO DELETE ELEVEN POSITIONS AT VARIOUS CLASSIFICA-
TIONS FROM THE TOTAL AUTHORIZED PERSONNEL AT A LATER
DATE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSS-
MENT AND ENROLLMENT OF THIS ORDINANCE; AND PROVIDING AN
EFFECTIVE DATE.
BE IT HEREBY KNOWN:
WHEREAS, the Fire Chief has requested the City Council to
readjust and thereafter specify the total authorized number of
civil service positions at each rank in the Fire Department for
the 1992-1993 Fiscal Year; and
WHEREAS, due to ongoing organizational changes being imple-
mented within the Department, the duties of many positions are
being redistributed among other existing positions; and
WHEREAS, in previous ordinances, the City Council has
expressed the intent to reorganize certain positions within the
Fire Department, meaning that from time to time, and as normal
attrition from the Department occurred, certain positions being
occupied by civil service personnel would be removed from the
classified service by ordinance while at the same time the
Department would maintain efficient operations by redistributing
those duties to other personnel. This intent was expressed as
being in the best interest of the Fire Department and the City of
Fort Worth in providing the citizens of Fort Worth the most
efficient fire protection possible at the lowest expense neces-
sary. Therefore, it is now recommended that the City Council
continue to express in specific terms the intent and prior notice
to delete and abolish eleven {11) more positions at various
classifications during the 1992-1993 Fiscal Year as normal attri-
tion occurs. It is further recommended that this intent be
clearly expressed so as to negate any expectancy for promotion
into said positions which will be deleted as vacancies occur; and
WHEREAS, the specification and authorization by ordinance of
the correct number of authorized civil service positions is a
statutory requirement; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That, effective immediately upon passage of this ordinance,
the following positions are the only civil service positions for
each classification (rank) authorized in the City of Fort Worth
Fire Department for the Fiscal Year of 1992-1993 or until a subse-
quent ordinance is enacted to modify said authorized positions:
Deputy Chiefs 6
Battalion Chiefs 17
Captains 76
Lieutenants 9g
Engineers 157
Firefighters 302
TOTAL 656

SECTION 2.
The following number of positions at the following classifi-
cations (ranks) will be deleted upon the occurrence of a corres-
ponding vacancy from time to time as normal attrition occurs
during the 1992-1993 Fiscal Year:
Deputy Chief 1
Captain 6
Lieutenant 3
Engineer 1

SECTION 3.
This ordinance shall be cumulative of all provisions of pre-
vious ordinances and of the Code of the City of Fort Worth, Texas
(1986), as amended, except where the provisions of this civil
service staffing ordinance are in direct conflict with the provi-
sions of such ordinances and such Code, in which event conflicting
provisions of such ordinances and such Code are hereby repealed..
SECTION 4.
The "Mayor and Council Communication" memorandum which is
presented contemporaneously with this ordinance is hereby
expressly incorporated herein by reference for further clarifica-
tion and explanation of the purpose and intent of the Council in
their adoption of this ordinance.
SECTION 5.
it is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and, if any phrase, clause, sen-

tence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 6.
The City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the
caption and effective date in the minutes of the City Council and
by filing the ordinance in the ordinance records of the City of
Fort Worth, Texas.
SECTION 7.
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached ordinance to establish the authorized number of positions in
each classification (rank) of the civil service personnel in the Fire Department
as of the beginning of Fiscal Year of 1992-1993, and also to express the intent
to delete eleven positions at various classifications as attrition occurs during
the Fiscal Year.
DISCUSSION:
The Fire Department's FY 92-93 budget resulted in a reduction of nine (9) civil service
firefighter positions from the previous authorized level due to normal attrition which
has occurred and pursuant to previous ordinances expressing the intent to make
staffing reductions. Following these deletions, the Fire Department's authorized civil
service strength is 656 total positions for the beginning of FY 92-93. Thereafter,
there will be an additional eleven (11) positions deleted at various ranks as normal
attrition occurs (no layoffs). Such intent is declared so as to negate any employee
expectancy for promotion into the positions as they become vacant.

The Director of Fiscal ,Services certifies that the civil service staffing levels
proposed in the proposed ordinance do not require the expenditure or allocation of
additional funds: The staffing adjustments described are made as a clarification of
and consistent with the staffing levels authorized in Ordinance No. 11151, the FY 92-93
annual appropriations ordinance adopted September 15, 1992.
