AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF.THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
THE JACRSBORO HIGHWAY
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ,ORDINANCE RECORDS OF THE
CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the
hereinafter.described portions of.streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising, grading and filling same and by constructing thereon .the following, to-wit:
JACRSBORO HIGHWAY From approximately 366' east of North
Commercial Street to University Drive;
an 8-inch thick cement surface on a
six-lane, 68 feet wide roadway.
III.
A hearing be given and held by and before the City Council of the City
of Fort Worth, Texas, to all owning or claiming any property abutting upon said
portions of highways, streets, avenues and public places, as well as to all
owning or claiming any interest in any such property. Such hearing shall be
given and held on the 14th day of July f 19 69 , at 9:30 a.m.
in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and
the City Secretary is hereby directed to give or cause to be given notice of the
time and place of such hearing and of other matters and facts in accordance with
the terms and provisions of an Act passed at the First Called Session of the
Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts
of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes
as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1,
emergency effective May 12, 1967. Such notice shall be by advertisement inserted
at least three (3) times in a newspaper published in the City of Fort Worth,
Texas, the first publication to be made at least twenty-one (21) days before
the date of said hearing. Said notice shall comply with and be in accordance with
the terms and provisions of said Act as amended. The City Secretary is further
directed to give or cause to be given personal notice of the time and place of
such hearing to all owning or claiming any property abutting on said portions of
highways, streets, avenues and public places, as well as to all owning or claiming
any interest in any such property. Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by depositing such
written notice in the United States Mail at least fourteen (14) days before the
date of the hearing, postage prepaid, in envelopes addressed to all persons
owning or claiming any interest in the respective properties abutting the high-
ways, streets, avenues and public places or portions thereof to be improved, as
the names of such persons are shown on the current rendered tax rolls of the City
of Fort Worth and at the addresses so shown, or if the name of such respective
owners do not appear on such rendered tax rolls, then address to such owners as
their names are shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses shown thereon. In those cases in which an owner of property
abutting a highway, street, avenue or public place or portion or portions there-
of which is to be improved is listed as "unknown" on the then current City of
Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth
tax rolls but no address for such owner is shown, no notice need be mailed. In
those cases where the owner is shown to be an estate, the mailed notice may be
addressed to such estate. In this connection, the City Secretary shall prepare
and file or cause to be prepared and filed with these proceedings a list of the
properties to be assessed, the names of those persons owning or claiming any
interest in said properties to whom the notice was mailed, together with the last
known addresses determined as aforesaid of the respective owners and those per-
sons owning or claiming any interest in said property.
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or unrendered tax rolls of the City
of Fort Worth was mailed a copy of _the notice of hearing and shall further certify
the date or dates on which said notice was mailed. A copy of each notice shall be
attached to such certificate. The certificate of the City Secretary will be con-
clusive evidence of the facts therein recited.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

ASSESSMENT PAVING OF JACKSBORO HIGHWAY
PROJECT NO. 104-35000-309
On June 2, 1969, 7:30 P.M., a Neighborhood Hearing was conducted by the
Engineering Division of the Public Works Department at City Hall Council
Chambers. The meeting was attended by 12 property owners. Procedures
concerning owner participation in the cost of mono curb and driveways,
methods and policies of determining assessments and street construction
standards were explained by Mr. Odell Schmidt, Assessment Paving Super-
visor. The meeting was then opened for a question and answer session.
Mr. A. L. Purvis represented Mrs. B. V. Wofford, owner of Tract 6,
R. Crowley Survey, who was ill in the hospital. She feels this project
will not improve the value of her property. She would also like to have
street lights in this area and has asked previously that this be done.
Mrs. Isabelle Alexander, Tract 4, R. Crowley Survey, expressed the feeling
that she did not believe it would help their property, with the amount of
taxes paid she believes the City should absorb the cost. When the back
portion of their property was condemned for the Police and Fire Training
Center they were only paid 8¢ square foot. She feels this small amount
paid them should be considered when this assessment is figured.
Mrs. S. Spartas, Tract 1, J. Baugh Survey, questioned possible future land
filling on their tract which is adjacent to the bridge approach and has no
assessment. She was advised that access to Jacksboro Highway would have to
be coordinated with the state when they considered doing this in the future.
Mr. Jim Klidas, Tract 4, Bailey Gardens Addition, questioned a driveway
approved by Jack Daniels of Traffic Engineering which our plans did not
show. He advised this additional driveway would service two houses and
be used by Hancock Paint for unloading of 6 wheelers. This has been
verified by Mr. Daniels.
Mr. Pete Kogan, Lots 11 & 12, Block 134, North Fort Worth Addition,
questioned how much footage was between the back line of the driveway and his
property line. He was told the plans showed it to be approximately 28' .
Several general questions were asked before the meeting closed. The major
question from all attending was in regard to street lights in this area.
Each property owner seemed to feel this was more necessary than other
improvements.
The property owners were thanked for attending and the meeting adjourned.

Gentlemen:
In accordance with the proceedings of your Honorable Body, I have prepared
estimates of the cost of street improvements as shown below:
Estimates of the total cost of improvements on a portion of
Jacksboro Highway and portions of sundry other streets,
avenues and public places in the City of Fort Worth, Texas, and estimated amounts per
front foot to be assessed aginast abutting property and the owners thereof, on each
portion of street, avenue, and public place are as follows, to-wit:
UNIT NO. 1: JACKSBORO HIGHWAY FROM APPROXIMATELY 366' EAST OF NORTH COMMERCIAL
STREET TO UNIVERSITY DRIVE, to be improved by constructing concrete curbs and gutters
and additional pavements to provide a six-lane roadway 68 feet wide except for the
bridge and bridge approaches over the Trinity River which will remain 40 feet wide.
The Texas Highway Department will pay for the pavement widening, and the
City will pay for the curbs, gutters, driveways, and storm sewers with a portion of
this cost to be assessed against the owners of the abutting property.
The following assessment rates have been established:

Council action on the project described below is requested.
Project Description
This project consists of.widening Jacksboro Highway from White Settlement to
Northside Drive. The present rural highway-type facility is 40 feet wide.
It will be improved by constructing concrete curbs and gutters and ad4tional
pavement to provide a six-lane roadway 68 feet wide except for the bridge and
bridge approaches over the Trinity River, which will remain 40 feet wide.
The Texas Highway Department will pay .for the pavement widening, and the City
will pay for the curbs, gutters , driveways , and storm sewers with ;a portion of
this cost to be assessed against the owners of the abutting property. .
The City of Fort Worth has entered into an agreement with Texas Highway Depart-
ment as outlined in M&C C-1461, dated April 14, 1969, and M&C G-1372, dated
May 19, 1969, wherein the Texas Highway Department has agreed to pay the cost
of improving and paving the surface of the roadway; the City of Fort Worth
shall pay all of the remainder of the cost of said improvements after deduct-
ing the amounts herein specified to be paid by the Texas Highway Department
and by the abutting property owners.
Recommendations
It is recommended that:
1) The following bond fund transfer be approved:

2) That an ordinance be adopted:
a) Declaring the necessity for and ordering the improvements;
b) Making provisions for levying the assessments;
c) Directing the Public Works Department to prepare estimates of
costs and amounts proposed to be assessed;
d) Authorizing the City :Manager to execute an agreement with the
Texas Highway Department whereby the City agrees to pay
$40,600.00 in accordance with the agreement approved on
- MWC-1461, dated 4/14/69, and M&C G-1372, dated 5/19/69.
