AN ORDINANCE VACATING, ABANDONING AND CLOSING AND
EXTINGUISHING A UTILITY EASEP'IENT LOCATED WITHIN THE
WESTERN H ILLS ADD I 1~ I ON TO THE C I l~Y OF FORT WORTH ,
TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND;
REPEALING AI_L ORDINANCES IN CONFLICT HEREWITH: AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED SY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS=

P_R_T.C.T., and as
Exhibit "A", attached
same are vacated,
extinguished_
SECTION 1.
foot wide by approximately seven hundred
long utility easement located along the
Lots C--1 and C--3, Block 85, Western Hi 1 is
as recorded in Volume 388-196, Page 44,
Wore specifically described in attached
hereto and incorporated herein, be and the
abandoned and permanently closed and
SECTION 2.
THAT the fee to the land in the above described vacated
utility easement is hereby released and shall revert to the
adjacent owner as provided by law.
SECTTON 3_
THAT ail ordinances or parts of ordinances in conflict
herewith are hereby repealed_

THAT this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so
ordained.

LEGAL DESCRIPTION
5.0 FOOT UTILITY EASEMENT ON LOT C1 AND C3,
BLOCK 85 OF WESTERN HILLS ADDITION, SECTION 8
BEING a 3,623 square feet or 0.0832 acre tract of land situated in the
Hays Covington Survey Abstract No. 256, Tarrant County, Texas, being
part of Lot C1 and C3, Block 85 of Western Hills Addition, Section 8,
an addition to City of Fort Worth, Tarrant County, Texas according to
the plat thereof recorded in Volume 388-196, Page 44, Plat Records of
Tarrant County, Texas and being more particularly described as follows.
BEGINNING at a "x" on concrete found in the southeasterly line of
Interstate Highway 820 (a variable width right of way), said point
being the common west corner of said Lot C3 and Lot D, Block 85 of
Western Hills Addition, Section 8, an addition to City of Fort Worth,
Texas according to the plat thereof recorded in Volume 388-188, Page 63,
Plat Records of Tarrant County, Texas, said point being N 08°29'00"E, a
distance of 417.34 feet from a 1/2 inch iron rod found at the
intersection of the southeasterly line of Interstate Highway 820 with
the northerly line of North Normandale Street (an 80 foot right of way);
THENCE, N 89°50'00" E, with the common line of said Lot C3 and Lot D, a
distance of 200.00 feet to a PK nail found for a corner;
THENCE, S 08°29'00" W, continuing with the said common line, a distance
of 200.00 feet to a 1/2 inch iron rod found for a corner, said point
being the common corner of said Lot C3 and Lot Cl and Lot D;
THENCE, S 89°36'00" E, with the common line of said Lot C1 and Lot D, a
distance of 139.71 feet to a 1/2 inch iron rod found for an angle point;
THENCE, N 54°25'00" E, continuing with the said common line, a distance
of 183.00 feet to a "x" on concrete found for a corner;
THENCE, S 35°35'00" E, continuing with the said common line, a distance
of 5.00 feet to a point for a corner;
THENCE, S 54°25'00" W, parallel with and 5.00 feet southeasterly of the
common line of said Lot C3 and Lot D, a distance of 184.62 feet to a
point for an angle point,
THENCE, N 89°36'00" W, parallel with and 5.00 feet southerly of the
common line of said Lot C1 and Lot D, passing the common line of said
Lot C3 and Lot C1 at a distance of 142.04 feet, continuing in all a
distance of 147.09 feet to a point for a corner,
THENCE, N 08°29'00" E, parallel with and 5.00 feet northwesterly of the
common line of said Lot C3 and Lot D, a distance of 199.94 feet to a
point for a corner;
THENCE, S 89°50'00" W, parallel with and 5.00 feet southerly of the
common line of said Lot C3 and Lot D, a distance of 194.94 feet to a
point for a corner in the southeasterly line of Interstate Highway 820;
THENCE, N 08°29'00" E, with the southeasterly line of Interstate
Highway 820, a distance of 5.06 feet to the Point of Beginning.

RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance vacating a 5-foot
wide by approximately 722-foot long utility easement located along the rear property
line of Lot C-1 and C-3, Block 85, Western Hills Addition, Section 8, as recorded in
Volume 388-196, Page 44, P.R.T.C.T.
DISCUSSION:
L. Lynn Katleck, of Katleck and Associates, developer of the property, has requested
that .a 5-foot utility easement located along the rear property line, as described above
and further delineated on the attached map, be vacated in order to more fully develop
the property. The subject utility easement does not contain any utility facilities.
Reviewing City departments and private utili ty companies have raised no objections to
this request.
This request is located in COUNCIL DISTRICT 3.
