ORDINANCE NO. ~
AN ORDINANCE APPROPRIATING $188,344.22 TO THE
WATER AND WASTEWATER OPERATING FUND AND
DESCREASING THE UNRESTRICTED, UNDESIGNATED
RETAINED EARNINGS BY' THE SAME AMOUNT FOR THE
PURPOSE OF THE FINAL PAYMENT TO VINSON AND
ELKINS FOR THE PURPOSE OF PROVIDING SPECIAL
EXPERTISE AND ASSISTANCE iN THE ARLINGTON RATE
CASE AND LITIGATION; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES AND REPEALING
ALL PRIOR ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR ENGROSSMENT :AND ENROLLMENT; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the
various City departments for the Fiscal Year 1991-92 and
in the Budget of the City Manager, there shall also be
increased appropriations in the Water and Wastewater
Operating Fund in the amount of $188,344.22 thereby
decreasing the unrestricted, undesignated Retained
Earnings by the same amount for the purpose of paying the
final payment to Vinson and Elkins, Attorneys at Law for
their representation in the Arlington Rate Case and
litigation. _._

SECTION 5.
This ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is
so ordained.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to execute final paymen

DISCUSSION:
On July 24, 1990, (M&C G-8740}, the City Council authorized the employment of Vinson
and Elkins to provide special expertise and assistance in the Arlington Rate Case and
litigation; on November 13, 1990 (M&C G-8900), the City Council authorized the
continuance with the firm. The contract was continued April 30, 1991 (M&C G-9126) in
an amount not to exceed $215,000.
The City has paid a total of $633,712.72 to Vinson and Elkins for these services,
however, the City subsequently determined its interests are better served by the firm
of Kelly, Hart and Hallman who are presently under contract.
