HomeMy WebLinkAboutOrdinance 11193., r cam, ' r. .~ ORDINANCE N0.~1 ~~~ AN ORDINANCE APPROPRIATING $42,000 00 TO THE WATER AND WASTEWATER OPERATING FUND AND DECREASING THE UNRESTRICTED, UNDESIGNATED RETAINED EARNINGS BY THE SAME AMOUNT FOR THE PURPOSE OF ACQUIRING LEASEHOLD IMPROVEMENTS ON LAKE WORTH LEASES, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1992-93 and in the Budget of the City Manager, there shall also be increased appropriations in the Water and Wastewater Operating Fund in the amount of $42,000 00 thereby decreasing the unrestricted, undesignated Retained Earnings by the same amount for the purpose of acquiring leasehold improvements on Lake Worth lease Lot 4, Block 28, from Teddilynn Wilson. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No 11151 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Adopt the attached supplemental appropriation ordinance increasing the Water and Sewer Operating Fund appropriations by $42,000.00 and decreasing the Unrestricted, Undesignated, Retained Earnings of the Water and Sewer Operating Fund ,by the same amount, and 2. Authorize the City Manager to acquire the leasehold improvements located on Lot 4, Block 28, Lake Worth Leases, from Teddilynn Wilson for $42,000.00. DISCUSSION: On March 4, 1981, M&C G-4890, the City Council approved the Lake Worth Land Use and Management Plan as prepared by Carter & Burgess, Inc. The leases in Phase II of this plan expired January 31, 1992. This lease is in that phase. A check will be made payable to a designated title company. This property was appraised by Paul Ondo, MAI. This property is located in DISTRICT 7. FISCAL INFORMATION/CERTIFICATION: The Director of Fiscal Services certifies that, upon adoption of the supplemental appropriations ordinance, funds required for this expenditure will be available in the current operating budget of the Water and Sewer Operating Fund.
