HomeMy WebLinkAboutOrdinance 11096S~. i~ ~ ORDINANCE NO . ~ I ~ -` ~J AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTINGUISHING PORTIONS OF TWO STREET RIGHTS-OF-WAY AND AN ALLEY RIGHT-OF-WAY LOCATED WITS-IIN THE HYDE JENNINGS SUBDIVISION OF THE JENNINGS SOUTH ADDITION TO THE CITY OF FORT WORTH, TEXASs PROVIDING FOR REVERSION OF FEE IN SAID LAND: REPEALING ALL ORDINANCES IN CONFLICT HF_RF_WITH~ AND PROVIDING AN EFFECTIVE DATE. BE Il" ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS= SECTION i. THAT {i) the street right-of-way of South Lake Street, as it runs from West Daggett Street southward to West Peter Smith Street and located between Block 24 and'Blocks 25 and 30, and (2) the street right-of-way of West Broadway Street as it runs from South Lake Street westward to the north-south alley located in Blocks 25 and 30, and located between Lot 8, Block 25 and Lot 1, Block 30, and { 3 ) the north-south alley right-of-way as it runs northward from West Broadway Street and located between Lots 5 through 8 and Lats 9 through 12 and replatted Lot ].--R, Block 25s all within the Hyde Jennings Subdivision of the Jennings South Addition as recorded in Volume 106, Page b2, D_R.T.C_l"., and as more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same are vacated, abandoned and permanently closed and extinguished_ SECT"ION 2 . THAT the fee to the land in the above described vacated street and alley rights-of-way are hereby released and shaJ.l revert to the adjacent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and ail existing and prospective utilities_ SECTION 3_ THAT all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. DISCUSSION: Mr. George Bruckman, attorney representing Dannon Company, has .requested that the City vacate the above described street and alley rights-of-way for the purpose of development of an industrial facility. The subject street and alley rights-of-way contain utility facilities. Acceptable arrangements have been made for relocation of said utility facilities at the applicant's expense. Reviewing City Departments and private utility companies have raised no objections to this request. An acceptable replat has been submitted. This request is located in COUNCIL DISTRICT 8. FISCAL INFORMATION/CERTIFICATION: It has been determined, based on the nature of the project, that a $1.00 fee will satisfy the interest of the City of Fort Worth in these public rights-of-way and will compensate the City for the transfer of said rights-of-way.
