HomeMy WebLinkAboutOrdinance 10914ORDINANCE NO. ~~ AN ORDINANCE SPECIFYING THE ADJUSTED TOTAL NUMBER OF AUTHORIZED CIVIL SERVICE POSITIONS AT EACH RANK IN THE POLICE DEPARTMENT; AUTHORIZING ONE TEMPORARY OVERAGE CORPORAL/DETECTIVE POSITION; EXPRESSING THE CLEAR INTENT TO DELETE SAID OVERAGE POSITION AT A LATER DATE: PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE: PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSS- MENT AND ENROLLMENT OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. BE IT HEREBY KNOWN: WHEREAS, the Police Chief has requested the City Council to temporarily readjust and thereafter specify the total authorized number of positions at each rank in the Police Department for the remainder of the 1990-1991 fiscal year; and WHEREAS, the most recent ordinance concerning the authorized and budgeted positions for the Police Department adjusted the Department civil service staffing as follows: Deputy Chiefs 5 Captains 12 Lieutenants 42 Sergeants 105 Corporal/Detectives 169 Police Officers 649 982 WHEREAS, the Chief of Police now requests the Council to adjust the authorized number of Police Department civil service positions into conformity with the proposed changes as set forth immediately below in order to effect efficient economy of the operations of the City's municipal services; and ~~~ICIAL REC~~BD C~~yyyypppp ~Spp~jj~~G~~~1AgR~[Y E~• ~F~N4~EZp e~lYO w~ ~. WHEREAS, the specification and authorization of the correct number of budgeted civil service positions is now a necessity and is required by law to be established by ordinance; NOW, THERE- FORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That effective Tuesday, September 3, 1991, the following positions are the only civil service positions authorized in the City of Fort Worth Police Department for the remainder of the Fiscal Year 1990-91 or until modified by subsequent ordinance: Deputy Chiefs 5 Captains 12 Lieutenants 42 Sergeants 105 Corporal/Detectives 170* Police Officers 649 983 *Creates one temporary position. SECTION 2. This ordinance shall be cumulative of all provisions of pre- vious ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior civil service staffing ordinances for the Police Department and such Code, in which event conflicting provisions of such ordinances and such Code provisions are hereby repealed. ~F~IC~~L R~~iQQ ® ^s e~~~Y~p ~~~5 2 The "Mayor and ~Cy~ouncil Communication" memorandum of ~, 1 qj , reference No. /iit(~~r°9~gD is hereby expressly incorporated herein by reference for further clarification and explanation of the purposes and intents of the Council in their adoption of this ordinance. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, para- graphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sen- tence, paragraph or section. SECTION 4. DISCUSSION: On August 22, 1991, the Civil Service Commission conducted a hearing to consider the appeal of a police officer who had been passed over for promotion to the rank of corporal due to previous performance evaluations. The appeal had been pending for some eighteen months, meaning that the promotional eligibility list current at that time has since expired. As a result of the hearing and based upon the officer's improved performance during the interim, the Commission ruled that the officer was to be promoted to the rank of corporal effective September 3, 1991, but that no retroactive award of back pay or other benefits would be made. The Commission acknowledged the peculiarities involving civil service promotions and the necessity of establishing a specified number of positions by ordinance. The Commission further expressed a desire not to inadvertently create another promotional appeal by "bumping" another officer on the current promotional eligibility list in order to accommodate their decision. Therefore, the Commission respectfully recommended the creation of one temporary overage position until shortly after the current eligibility list expires in November. The proposed ordinance temporarily increases the total authorized number of police personnel. The ordinance would only authorize a temporary increase in the total number of corporals for approximately three months. The budget impact will only amount to the difference in salary between an officer's pay and that of a corporal's pay for the short period. ~' Creation of the temporary overage position will increa e~aau rt~ number of corporal positions from 169 to 170.
