AN ORDINANCE AMENDING CHAPTER 20, "LICENSES AND
MISCELLANEOUS BUSINESS REGULATIONS", AND CHAPTER 21,
"MOBILE HOME AND RECREATIONAL VEHICLE PARKS", OF THE
CODE OF THE CITY OF FORT WORTH, TEXAS (1986), AS
AMENDED, BY AMENDING ARTICLE IV, SUBSECTION 20-164(B)
OF CHAPTER 20; ARTICLE II, SECTION 21-54, OF
CHAPTER 21; ARTICLE II, SECTION 21-55, OF CHAPTER 21,
ARTICLE III, SECTION 21-144, OF CHAPTER 21; AND
ARTICLE III, SECTION 21-164 OF CHAPTER 21 THEREOF, TO
PROVIDE THAT FEES FOR PERMITS AUTHORIZED PURSUANT TO
THESE SECTIONS SHALL BE IN AN AMOUNT ESTABLISHED BY
CITY COUNCIL; PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING
FOR ENGROSSMENT AND ENROLLMENT; PROVIDING FOR PUBLICA-
TION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFEC-
TIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That Article IV of Chapter 20, "Licenses and Miscellaneous
Business Regulations", of the Code of the City of Fort Worth,
Texas (1986), as amended, be and is hereby amended by deleting
existing Subsection 20-164(b) and replacing it with a new
Subsection 20-164(b), to read as follows:
"Sec. 20-164. Permit fees
"(a) Remains unchanged.
"(b) Permits shall be issued in accordance with the
application procedures and upon payment of the permit
fees per pushcart in the amount established by City
Council."
That Article II of chapter 21, "Mobile Home and Recreational
Vehicle Parks", of the Code of the City of Fort Worth, Texas
(1986), as amended, be and is hereby amended by deleting existing
Section 21-54 and replacing it with a new Section 21-54, to read
as follows:
"Sec. 21-54. Fees.
"All original license applications or renewals
thereof under this division shall be accompanied by a
fee in the amount established by City Council for a
mobile home park license. The original fee shall be
prorated on the nearest quarterly basis between the
date of the original license and October first of that
fiscal year. All renewal fees shall be due on October
first of each year."
That Article II of Chapter 21, "Mobile Home and Recreational
Vehicle Parks", of the Code of the City of Fort Worth, Texas
(1986), as amended, be and is hereby amended by deleting existing
Subsection 21-55(b) and replacing it with a new Subsection
21-55(b), to read as follows:
"Sec. 21-55. Transfer.
"(a) Remains unchanged.
"(b) All applications for license transfer shall be
accompanied by a fee in the amount established by City
Council."
That Article III of Chapter 21, "Mobile Home and
Recreational Vehicle Parks", of the Code of the City of Fort
Worth, Texas (1986), as amended, be and is hereby amended by
deleting existing Section 21-144 and replacing it with a new
Section 21-144, to read as follows:
"Sec. 21-144. fee.
"All applications to the building official for a
permit required by this division shall be accompanied
by a fee in the amount established by City Council."
That Article III of Chapter 21, "Mobile Home and
Recreational vehicle Parks", of the Code of the City of Fort
Worth, texas (1986), as amended, be and is hereby amended by
deleting existing Section 21-164 and replacing it with a new
Section 21-164, to read as follows:

"Sec. 21-164. Fees.
"All original license applications or renewals
thereof under this division shall be accompanied by a
fee in the amount established by City Council. The
original fee shall be prorated on the nearest quarterly
basis between the date of the original license and
October first of that fiscal year. All renewal fees
shall be due on October first of each year."
SECTION 2.
This ordinance shall be cumulative of all provisions of ordi-
nances and of the Code of the City of Fort Worth, Texas (1986),
as amended, except where the provisions of the ordinance are in
direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances
and such Code are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and, if any phrase,
clause, sentence, paragraph or section of this ordinance shall be
declared unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences, para-
graphs and sections of this ordinance, since the same would have
been enacted by the City Council without the incorporation in
this ordinance of any such unconstitutional phrase, clause,
sentence, paragraph or section.
SECTION 4.
The City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the

caption and effective date in the minutes of the City Council and
by filing the ordinance in the ordinance records of the City.
SECTION 5.
The City Secretary of the City of Fort Worth, Texas, is
hereby directed to publish the caption and effective date of this
ordinance for two (2) days in the official newspaper of the City
of Fort Worth, Texas, as authorized by Section 53.013, Texas
Local Government Code.
SECTION 6.
This ordinance shall be in full force and effect from and
after the date of its passage and publication, and it is so
ordained.

PUSHCART PERMITS
Annual permit fee per pushcart or per
first pushcart operated by any person $150.00
Annual permit fee for each additional
pushcart operated by any person $ 50.00
MOBILE HOME PARK LICENSES
License fee consists of:
$50.00 fee plus $1.00 for each
mobile home space in the mobile home park
License transfer fee
RECREATIONAL VEHICLE PARKS LICENSES
$ 25.00
Permit application fee to building official
for construction permit $ 50.00
License fee consists of:
$50.00 fee plus $1.00 for each
recreational vehicle space in the
recreational vehicle park.

RECOMMENDATIONS:
It is recommended that the City Council:
1. Adopt the attached ordinance amendment which would remove references to
specific amounts of fees charged by the Public Health Department from the
Code of the City of Fort Worth, Texas in Chapters 5, 20, and 21, and
provide that amounts of such fees will be established by City Council in
an M&C, and
2. Adopt the attached schedule of fees for permits and licenses authorized
for Chapters 20 and 21 of the City Code

Currently each time a new fee is introduced or an existing fee is changed, the
ordinance also has to be changed. To facilitate the process of introducing new
fees and changing existing fees, the proposed ordinance amendment would delete
specific fee amounts from the City Code and authorize City Council to establish
fee amounts by the M&C process. The attached schedule of fees proposed for
Council adoption with this Mayor and Council Communication contains no changes
from the existing fee schedule.
FINANCING:
No additional financing is required.
