AN ORDINANCE SPECIFYING THE ADJUSTED TOTAL NUMBER OF
AUTHORIZED CIVIL SERVICE POSITIONS AT EACH RANK IN THE
FIRE DEPARTMENT; DELETING ONE LIEUTENANT POSITION AND
FIVE ENGINEER POSITIONS FROM THE TOTAL AUTHORIZED
PERSONNEL CLASSIFICATIONS; PROVIDING THE STATEMENT OF
INTENT TO DELETE FOUR MORE ENGINEER POSITIONS FROM THE
TOTAL AUTHORIZED PERSONNEL AT A LATER DATE; PROVIDING
THE STATEMENT OF INTENT TO ADD FIVE ADDITIONAL FIRE-
FIGHTER POSITIONS TO OFFSET THE SAID DELETION OF FIVE
OF THE ENGINEER POSITIONS AS THEY OCCUR; PROVIDING THAT
THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERA-
BILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLL-
MENT OF THIS ORDINANCE; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Fire Chief has requested the City Council to
readjust and thereafter specify the total authorized number of
civil service positions at each rank in the Fire Department for
the remainder of the 1990-91 Fiscal Year; and
WHEREAS, it is now recommended that the City Council autho-
rize the immediate deletion of one (1) Lieutenant position and
five (5) Engineer positions from the total authorized personnel
within the Department. Due to organizational changes being imple-
mented within the Department, the duties of said positions are
being redistributed among other existing positions. Therefore,
the said positions are no longer necessary to achieve the effi-
cient operations of the Fire Department; and
WHEREAS, in previous communications, as well as in previous
ordinances, the City Manager's office and the Fire Chief
expressed the intent to reorganize certain positions within the
Fire Department, meaning that from time to time, and as normal
attrition from the Department occurred, certain positions being
occupied by civil service personnel would be removed from the
classified service by ordinance while at the same time the
Department would maintain efficient operations by redistributing
those duties to other personnel. This intent was expressed as
being in the best interests of the Fire Department and the City
of Fort Worth in providing the citizens of Fort Worth the most
efficient fire protection possible at the lowest expense neces-
sary. Therefore, it is now recommended that the City Council
continue to express in specific terms the intent and prior notice
to delete and abolish four (4) Engineer positions, in addition to
the five (5) immediate deletions above for a total of nine (9)
Engineer deletions, and to offset a portion of said deletions as
they occur by adding five (5) additional Firefighter positions to
the department's personnel. It is further recommended that this
intent be clearly expressed so as to negate any expectancy for
promotion into said Engineer positions which will be deleted as
vacancies occur; and
WHEREAS, it is proposed that said positions be deleted from
the civil service of the Department from time to time as
vacancies occur, primarily from normal attrition from the
Department; and
WHEREAS, the Chief of the Fire Department now requests that
the Council adjust the authorized number of Fire Department civil
service positions into conformity with the proposed changes as
set forth immediately above in order to effect efficient economy
of the operations of the City's municipal services; and
WHEREAS, the specification and authorization by ordinance of
the correct number of authorized civil service positions is a
statutory requirement; NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That effective immediately upon passage of this ordinance,
the following positions are the only civil service positions
authorized in the City of Fort Worth Fire Department until a sub-
sequent ordinance is enacted to modify said authorized positions:

District Chiefs 17
Captains 76
Lieutenants 98*
Engineers 156**
Firefighters 332***
Total 685
* Deletes one Lieutenant position.
** Deletes nine Engineer positions, five (5) immediately and
four (4) more as attriton occurs.
*** Increase by five Firefighter positions contemporaneously
with the deletion of the last five (5) Engineer deletions.
SECTION 2.
This ordinance shall be cumulative of all provisions of pre-
vious ordinance and of the Code of the City of Fort Worth, Texas
(1986), as amended, except where the provisions of this staffing
ordinance are in direct conflict with the provisions of such ordi-
nances and such Code, in which event conflicting provisions of
such ordinances and such Code are hereby repealed.
The "Mayor and Council Communication" memorandum of April 9,
1991, reference No. G-9099, which is contemporaneous with this
ordinance, is hereby expressly incorporated herein by reference
for further clarification and explanation of the purpose and
intent of the Council in their adoption of this ordinance.

SECTION 3.
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and, if any phrase,
clause, sentence, paragraph or section of this ordinance shall be
declared unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences, para-
graphs and sections of this ordinance, since the same would have
been enacted by the City Council without the incorporation in
this ordinance of any such unconstitutional phrase, clause, sen-
tence, paragraph or section.
SECTION 4.
The City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the
caption and effective date in the minutes of the City Council and
by filing the ordinance in the ordinance records of the City of
Fort Worth, Texas.
SECTION 5.
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance to
immediately decrease the total number of authorized Fire Lieutenant positions
from ninety-nine (99) to ninety-eight (98), the total number of authorized
Fire Engineer positions from one hundred sixty-five (165) to one hundred sixty
(160), and express the intent to delete four additional Engineer .positions and
add five Firefighter positions.
DISCUSSION:
The Fire Department's FY 90-91 budget includes a reduction of thirty (30)
Civil Service positions of various ranks, seventeen of which were eliminated
October 1, 1990, and thirteen to be deleted during the first quarter of the
fiscal year through normal attrition. Following these deletions, the Fire
Department's authorized Civil Service strength would be 685. On July 17,
1990, City Council approved M&C G-8733 adopting an ordinance (Ordinance No.
10640) deleting two Captain positions and stating the Fire Department's intent
to delete the thirty (30) additional Civil Service positions. Such intent was
declared so as to negate any employee expectancy for promotion into the
positions as they become vacant. Since that time, City Council has approved
the deletion of two additional Captain positions and three Lieutenant
positions (M&C G-8844, G-8870, and G-9034).
Deletion of one Lieutenant and five Engineer positions now will change the
current authorized strength as follows:

Since the adoption of the 1990-91 budget, the Fire Department has reassessed
its staffing needs in various ranks relative to the overall staffing of 685
Civil Service employees. It was found that more effective and efficient
operations would be achieved if the department was staffed with 332
Firefighters instead of the authorized strength of 327, 156 Engineers instead
of 160, and 98 Lieutenants instead of 99. Five Firefighter positions will be
added in exchange for the Engineer and Lieutenant positions to be deleted.
Under this staffing configuration, the resulting total Civil Service employees
will remain at 685. The deletion of the additional Lieutenant position at
this time reflects the new configuration. The remaining four Engineer
positions will be eliminated as vacancies occur. The final authorized Civil
Service staffing will be:

FINANCING:
The 1990-91 Fire Departm ent budget anticipated the deletion of five Engineer
positions, therefore, no additional costs or savings are realized by the dele
tions. The downgrading of Engineers to Firefighters will result in a modest
salary savi ngs to the de partment.
