AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING TWO ALLEY RIGHTS-OF-WAY LOCATED WITHIN THE
M. G. ELLIS ADDITION TO THE CITY OF FORT WORTH, TEXAS;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
THAT the twenty (20) foot wide by approximately five hundred
sixty (560) foot long alley right-of-way located between Lots 1
through 11 and 14 through 24, Block 41, M. G. Ellis Addition, as
recorded in Volume 63, Page 19 and 20, P.R.T.C.T., and as more
specifically described in attached Exhibit "A", attached hereto
and incorporated herein, and the east one-half (1/2) of the alley
right-of-way (approximately ten [10] feet wide) located west of
the west property line of Lot 3 and all of a twenty (20) foot
wide by four hundred (400) foot long alley right-of-way located
between Lots 4 through 11 and 14 through 21, Block 42,
M. G. Ellis Addition, as recorded in Volume 63, Page 19 and 20,
P.R.T.C.T., and as more specifically described in attached
Exhibit "B", attached hereto and incorporated herein are vacated,
abandoned and permanently closed and extinguished.
SECTION 2.
That the fee to the land in the above described vacated
alley rights-of-way are hereby released and shall revert to the
adjacent owner as provided by law, SAVE AND EXCEPT that easements
are retained for any and all existing and prospective utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict here-
with are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so
ordained.

RECOMMENDATION:
It is recommended that the City Council adopt an ordinance vacating a 20' wide
by approximately 560' long alley located between Lots 1 through 11 and 14
through 24, Block 41, M.G. Ellis Addition, as recorded in Volume 63, Page 19
and 20, P.R.T.C.T., and the east 1/2 of an alley (approximately 10' wide)
located west of the west property line of Lot 3 and all of a 20' wide by 400'
long alley located between Lots 4 through 11 and 14 through 21, Block 42, as
recorded in Volume 63, Page 19 and 20, P.R.T.C.T., as recommended by the City
Plan Commission.
DISCUSSION:
Mr. Donis Hatchett, representing Weaver Development Company and North Fort
Worth Bank, owners of all adjacent property, has requested that the City vacate
the alley rights-of-way (attached map). The subject alley, acquired by
dedication, is open on the ground and does contain sewer, electric and
telephone utility facilities. The subject alleys will be retained as utility
easements to accommodate the existing utility facilities. The subject vacation
request has been made in order to replat the vacated right-of-way with the
adjoining property.
The Land Agent for the City of Fort Worth has determined that dedication of the
remainder of Lot 13, Block 41, M.G. Ellis Addition, (a portion of N.W. 28th
Street) will satisfy the standard consideration fee and will satisfy the
interest of the City of Fort Worth in this public right-of-way.
Reviewing City departments and private utility companies have raised n.o
objection to this request. A satisfactory replat has been submitted.
