HomeMy WebLinkAboutOrdinance 528 ORDINANCE NO.rv: An Ordinance granting the St. Louis & Southwestern � - Railway Company of Texas, the right to lay and to maintain a switch or spur railway track upon and along Hampton Street in the City of Fort Worth a.nd across and over Oak and Garvey y Streets all within the Corporate Limits of the City ofFort Worth, and providing for indemnity against damages to property or injury to persona on account of the construction of said switch • BE IT ORDAINED BY THE BOARD OF COMISSIOMM—S OF THE CITY OF FORT WORTH: SEC. 1. Whereas, the St. Louis & Southwestern Railway Company of Texas has heretofore secured, and now has a franchise to operate a line of railway track along certain streets within the corporate limits of the City of Fort :forth, and whereas said railway company desires to build, extend and construct a spur or switch track along, upon and over a portion of Hampton Street, a total distance. of about 575 feet hereinafter fully described, now therefore be it resolved: Company SEC. 2. The St. Louis : & Southwestern Railway/of Texas is hereby granted the right to build, construct,x= maintain and operate within the City of Fort Worth in Tarrant County, Texas, a line of railway track along and over a portion of Hampton Stre=et, the same being a spur or switch track beginn- ing at its present line of railway track which said spur track or switch is located and described as follows: "DESCRIPTION OF THE LOCATION OF THE CMTTM- LINE OF THE PROPOSED SPUR TRACK TO BE CONSTRUCTED BY THE ST. LOUIS & SOUTIiV'PLST-AMT RAILWAY COMPANY ON HAMPTON ST=,,T IN THE CITY OF FORT WORTH, TMAS: Beginning at a point about ten feet North- west of the North- west corner of Denver & Hampton Stre,its (taken at right angles to the track) on an existing track o:s the St.. Louis & Southwedtern Rail- road, whose center line is 25' east of and parallel to the East line of Hampton Street, North of Denver Avenue; Thence in a Southerly direction to the right on about •a 14 deg. curve, 234 feet to a point of tangent 10 feet east of the west line of Hampton Streit, South of Denver Avenue; Thence South 10 feet East of rand parallel with the West line of Hampton Street 341. .feet to the South line of Garvey street, a total distance of 575 feet. " A blue ptint and sketch of the proposed line of said switch is attached to and made a part of this Ordinance. Seo. 3. The said St. Louis & Southwestern Railway Company p Y of Texas shall have the right to construct, maintain and operate a single line of railway track over, along and across said streets as described in Section 2 hereof at such grade or grades as it may elect to use and as may be approved by the City Engineer for the City of fort Worth, and it is expressly provided that the laying and construction of all of said line of railway and tracks over the streets as hereinbefore designat- ed and named, shall be under the supervision of the City Engineer and the Board of Commissioners of the City of Fort Worth, and shall in all things be subject to their approval. SEC. 4. It is, however, expressly provided that the said 5t. Louis & Southwestern Railway Company shall at its of the construction own cost and expense immediately after the completion/of said track, put the said street in as good/condition as it was prior to the construction of said track thereon, and on this feature the City Engineer shall be the exclusive Judge as to when this section of this ordinance shall have been complied with. .e' SEC. 5. The franchise and right herein given to said Railway Company is subject to all of the provisions of the Charter and Ordinances of the City of Fort Worth. SEC. G. This franchise and right shall be subject to all of the provisions, limitations and covenants and run concurrent with the criginal franchise heretofore granted by said City to said St. Louis & Southwestern RailwnW Company and its assigns, to construct, maintain and operate lines of railroad track within said City. Sec. 7. It is expressly understood between the St. Louis & Southwestern Railway Company and the City of Fort Worth that the said Railroad Company shall save the City of Fort Worth harmless from all damage to property or injuries to individuals on account of the conA ruction of said switch, and the laying #3• of said track on said street as herein described shall be c"on- siderea as a full and complete acceptance and agreement on the part of said Railway Company of all of the terms of this Ordi- nance, sm. I hereby certify that the above and forgoing Ordinance was duly pre- sented and unanimously passed and adopted by the Board of Commission- ers of the City of Fort Worth at a regular session of said Board held Tuesday, August 22nd, A.
