HomeMy WebLinkAboutOrdinance 10829s ~~ a ORDINANCE N0. /i~8c~ AN ORDINANCE SPECIFYING THE ADJUSTED TOTAL NUMBER OF AUTHORIZED CIVIL SERVICE POSITIONS AT EACH RANK IN THE POLICE DEPARTMENT; DELETING ONE OVERAGE CORPORAL/ DETECTIVE POSITION IN THE DEPARTMENT; ADDING ONE POLICE OFFICER POSITION; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PRO- VIDING FOR ENGROSSMENT AND ENROLLMENT OF THIS ORDI- NANCE; AND PROVIDING AN EFFECTIVE DATE. BE IT HEREBY KNOWN: WHEREAS, the Police Chief has requested the City Council to readjust and thereafter specify the total authorized number of positions at each rank in the Police Department for the remainder of the 1990-1991 fiscal year; and WHEREAS, the most recent ordinance concerning the authorized and budgeted positions for the Police Department, adjusted the Department civil service staffing as follows: Deputy Chiefs 5 Captains 12 Lieutenants 42 Sergeants 105 Corporal/Detectives 170 Police Officers 647 981 WHEREAS, the Chief of Police now requests the Council to adjust the authorized number of Police Department civil service positions into conformity with the proposed changes as set forth below in order to effect efficient economy of the operations of the City's municipal services; and WHEREAS, the specification and authorization of the correct number of budgeted civil service positions is now a necessity and is required by law to be established by ordinance; NOW, THERE- FORE, S BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That immediately upon passage of this ordinance, the follow- ing positions are the only civil service positions authorized in the City of Fort Worth Police Department for the remainder of the Fiscal Year 1990-91 or until modified by subsequent ordinance: Deputy Chiefs 5 Captains 12 Lieutenants 42 Sergeants 105 Corporal/Detectives 169* Police Officers 648** 981 *Deletes one overage position. **Creates one new position. SECTION 2. This ordinance shall be cumulative of all provisions of pre- vious ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior civil service staffing ordinances for the Police Department and such Code, in which event conflicting provisions of such ordinances and such Code provisions are hereby repealed. The "Mayor and Council Communication" memorandum of ~- ~'~ ~6, ~ ~ ~ ~ , reference No . s '' ~ t l Z , prepared contemporaneously here- with, is hereby expressly incorporated herein by reference for further clarification and explanation of the purposes and intents of the Council in their adoption of this ordinance. 2 S SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, para- graphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sen- tence, paragraph or section. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 5. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. Adopt the attached ordinance which: ~:~„~>~: ~~,~ a. Adds one Police Officer position in the North Division of the Police Department, Fund GGO1., Center No. 0354100; and w b. Deletes one temporary overage Corporal/Detective position in° the South Division of the Police Department, Fund GGO1, Center No. 0355100. 2. Adopt. the attached appropriations ordinance increasing estimated receipts and appropriations by $28,354 in Grant Fund GR76, Center 035206564000 from increased revenue. DISCUSSION: On M&C G-8902 dated November 13, 1990, the City Council approved 981 authorized civil service positions within the Police Department. At that time. there were 647 authorized Police Officer positions. Also, the department had 169 authorized Corporal/Detective positions but actually had 170 Corporal/Detectives. The Fort Worth Housing Authority has applied and received from the Department of Housin and Urban Develo ment funding for a grant entitled Neighbors Against Drugs NAD T is program was developed to help eliminate drug- related crime in public housing, specifically targeting the Butler Place/Addition. The program will require a cooperative effort from the Fort Worth Police Department, local social service and community agencies, the Fort Worth Housing Authority and residents of the Butler Place/Addition to provide alternatives to drugs and drug related crime. Primarily, the program will encompass a three phased approach which includes: Police: A uniformed Police Officer, with flexible hours stationed at Butler to establish a "community policing" patrol. Prevention: Fort Worth Housing Authority personnel to interface with community/social service agencies to institute training and self esteem modules in an effort to reduce drug-related crime. Intervention: Fort Worth Housing Authority personnel to counsel and focus on youth at the middle school level and above. In order to provide the Police Officer to the Butler Place/Addition it is necessary that the Police Department's authorized strength be increased. With the resignation of a Corporal/Detective on December~21, 1990, the temporary overage can now be deleted. Upon approval and completion of Recommendation 2, sufficient funds will be available in Grant Fund 76, Center 035206564000, Neighbors Against Drugs, to accomplish the "community policing patrol." Expenditures will be made from Ac count No. 511010 for payroll, 518070 for retirement contributions.
