ORDINANCE N0. ~~
AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH INCREASING THE RESIDENTIAL HOMESTEAD EXEMPTION
FROM AD VALOREM TAXES FOR DISABLED PERSONS; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND
ENROLLMENT; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, Article 8, Section 1-b of the Constitution of the
State of Texas, permits a city to exempt by its own action not
less than $3,000 of the market value of residence homestead of
disabled and elderly persons; and
WHEREAS, the City Council of the City of Fort Worth desires
to raise the residential homestead exemption for disabled citi-
zens from $20,000 on the assessed valuation of a residence to
$40,000 on the assessed valuation of a residence, pursuant to the
provisions of Section 11.13 of the Property Tax Code of the State
of Texas;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION I.
There is hereby exempted the sum of Forty Thousand Dollars
($40,000) of the market value of residence homesteads of disabled
persons from all ad valorem taxes hereafter levied by the City of
Fort Worth. The term "disabled" shall have that meaning given in
Section 11.13 of the Tax Code of the State of Texas or any suc-
cessor statute. An eligible disabled person who is 65 or older
may not receive both a disabled and an elderly residence home-
stead exemption but may choose either.

SECTION II.
Should any part, portion, section or part of a section of
this ordinance be declared invalid or inoperative or void for any
reason by a court of competent jurisdiction, such decision,
opinion or judgment shall in no way affect the remaining por-
tions, parts, sections or parts of sections of this ordinance,
which provision shall be, remain and continue to be in full force
and effect.
SECTION III.
The City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the cap-
tion and effective date in the minutes of the City Council and by
filing the ordinance in the ordinance records of the City.
SECTION IV.
This ordinance shall take effect upon its passage and will
apply to the ad valorem taxes levied commencing with the year
1991.

RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance increasing
the Disabled Citizen Homestead Exemption from $20,000 to $40,000.
DISCUSSION:
Informal Report No. 7523, Review of Disabled Homestead Exemption Policy, was
presented at the April 9 Pre-Council meeting. At that time, the City Council
expressed interest in increasing the Disabled Citizen Homestead Exemption from
$20,000 to $40,000. The last day the City Council may adopt (or change) the
various local option percentage homestead exemptions is May 1, 1991, in order to
impact the 1991-92 budget year.
Under state law, property owners have until April 30 to apply for the various
property tax exemptions offered by the City for the next tax year. Property
owners apply for property tax exemptions through the Tarrant Appraisal District.
Each December, property owners who have exemptions receive a notice confirming
the exemptions.
FINANCING:
There are no expenditures anticipated from this recommendation. However, it is
anticipated the City of Fort Worth will lose an additional $119,000 in property
tax revenue, for a cumulative revenue loss of $345,000 on this exemption, as a
result of increasing the Disabled Citizen Homestead Exemption from $20,000 to
$40,000.
