ORDINANCE N0. ~~~
AN ORDINANCE AMENDING CHAPTER 14, "GARBAGE", OF THE CODE OF THE CITY OF
FORT WORTH (1986), AS AMENDED, WHICH CHAPTER REGULATES SOLID WASTE
COLLECTION, FEES AND DISPOSAL, BY AMENDING SECTION 14-25 TO ADJUST THE
HAND LOADED RATES FOR COMMERCIAL REFUSE COLLECTION, BY AMENDING SECTION
14-30 TO INCREASE PRESCRIBED UNIFORM FEES FOR DISPOSAL AT CITY LANDFILLS;
BY AMENDING SECTION 14-30 TO ADD A FEE FOR DISPOSAL OF TIRES; BY AMENDING
SECTION 14-31 TO ALLOW THE ACCEPTANCE OF TIRES AT CITY LANDFILLS;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF PRIOR ORDINANCES AND
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, PROVIDING A SEVERABILITY
CLAUSE; PRESERVATION OF RIGHTS AND REMEDIES FOR ACCRUED VIOLATIONS AND
PENDING LITIGATION; PROVIDING A PENALTY CLAUSE, PROVIDING FOR ENGROSSMENT
AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That those portions of Section 14-25 of Chapter 14 of the Code of the City of Fort
Worth(1986), as amended, consisting of the "Solid Waste Rate Schedule for Hand-Loaded
Commercial Service" and the following paragraph setting forth the formula for
calculation of such rates, be and the same are hereby amended, it being expressly
provided that the other provisions of Section 14-25 shall remain unchanged The
amended portion shall read as follows:

Where more than one (1) container is used by any one customer, the total monthly
charges shall include the minimum monthly charge of $10.95 plus a charge per container
(in excess of one) computed on the basis of fifty-eight ($0.58) cents per container per
stop. The computation shall be made on an annual charge divided by twelve and the
final rate shall be rounded to the nearest five cents ($0.5). [For example; if a
customer is provided service two times per week, eight containers per stop, the total
monthly charge would be calculated as follows:
$10.95 + [(7 x $0.58 x 2 x 52)/ 12]
$10.95 +$35.19 = $46.14
(rounded to $46.15)]
Where more than ten (10) containers are used by any one customer, the total monthly
charge (not shown on the above schedule) shall be calculated using the same formula.
SECTION 2.
That Section 14-30(a) of Chapter 14 of the Code of the City of Fort Worth (1986), as
amended, be and the same is hereby amended to read as follows:
"Sec. 14-30. Disposal Fees
(a) Persons disposing of refuse at any city-operated disposal site, incinerator,
transfer station or sanitary landfill, including persons holding a valid permit for
private collection and disposal of refuse, shall pay a fee for each and every load of
refuse disposed of in accordance with the following:
(1) Fort Worth residents, upon showing a current water bill showing a sanitation
charge and hauling from their residences in autos, pickups and single-axle
trailers: No charge.
(2) Fort Worth residents not presenting a current water bill indicating a sanitation
charge, commercial haulers from Fort Worth and outside Fort Worth, and private haulers
from outside Fort Worth•
Twenty dollars ($20.00) minimum charge for up to two thousand (2,000) pounds, five
dollars ($5.00) per five hundred (500) pounds thereafter.
(3) Vehicles or trailers hauling solid waste into waste disposal or transfer sites
whose loads are not covered or secured to prevent littering:
Three dollars ($3.00) surcharge per load in addition to other disposal fees.
(4) Fort Worth residents bringing tires to the landfill shall be charged a disposal
fee of two dollars ($2.00) per passenger vehicle (car/pickup), and five dollars ($5.00)
per truck tire. Only incidental tires may be accepted. Truckloads of tires will not
be accepted. The City shall have the right to refuse to accept any tire or load of
tires.

SECTION 3.
That Section 14-31(b) of Chapter 14 of the Code of the City of Fort Worth (1986), as
amended, be and the same is hereby amended to read as follows:
"Sec. 14-31. Requirements and prohibitions concerning various types of refuse at city
waste disposal and transfer sites.
(b) The following wastes shall not be accepted:
(1) Special wastes such as sludges, industrial waste, hazardous waste, infectious
wastes from health and veterinary facilities, dead animals, slaughterhouse waste,
asbestos, and other wastes which must be manifested to be legally disposed of will not
be accepted for disposal.
(2) Other wastes not accepted are automobile bodies, wastes in drums and liquids.
Loads of tires are not accepted and individual tires are not accepted except as
otherwise provided by this Chapter.
SECTION 4
That this ordinance shall be cumulative of all provisions of the Code of the City of
Fort Worth (1986), as amended, and all other ordinances of the City of Fort Worth,
except in those instances where the provisions of this ordinance are in direct conflict
with provisions of such Code or other ordinances, in which instances said conflicting
provisions of such Code or other ordinances are hereby repealed.
SECTION 5.
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and if
any phrase, clause, sentence, paragraph or section of this ordinance shall be declared
void, ineffective or unconstitutional by the valid judgement or decree of any court of
competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not
affect any of the remaining phrases, clause, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such void, ineffective or unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 6.
That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as
to any and all violations of the provisions of Chapter 14 of the Code of the City of
Fort Worth (1986), as amended, and of any other ordinance affecting garbage, which have
accrued at the time of the effective date of this ordinance, and as to such accrued
violations and all pending litigation, both civil and criminal, whether pending in
court or not, under such chapter and/or other ordinances, same shall not be affected
by this ordinance but may be prosecuted until final disposition by the courts.
SECTION 7.
That the City Secretary of the City of Fort Worth is hereby direct r
enroll this ordinance by copying the caption of this ordinance in t~~ s~~

SECTION 8.
That this ordinance shall become effective and be in full force and effect from and
after its adoption or October 1,1991, whichever date is later. Provided, however, that
the adjusted rates specified herein shall be reflected on customer utility statements
sent by the City of Fort Worth after October 1, 1991, and it is so ordained.

It is recommended that the City Council adopt the attached ordinance which~clarifiesr.
the rates for hand-loaded commercial service, increases the minimum charges and~aipp;}ng:<~:
fees at the City's landfill, and establishes a fee structure for the acceptance of~-
tires at the City's landfill, effective October 1, 1991.
DISCUSSION:
Hand-Loaded Commercial Service
The last time the garbage fees were amended (9/25/90, M&C G-8822) the formula used to
calculate the rates for hand-loaded commercial service was not included. The formula
for this service should be stated more clearly in the ordinance and adjustments- made
to the rate schedule for hand-loaded service to conform to this formula. In addition,
a rounding error occurred when updating the additional bag charge. The Commercial
Service charge for each additional bag should be $.58, instead of $.55. With the
correction and clarification of this rate schedule for hand-loaded commercial service,
commercial hand-loaded rates will decrease slightly.
Disposal Fees
The current rate at the City landfill is $16.00 per ton, with a $12.00 minimum. A
survey of private landfills indicate the minimum ranging from $20.00 to $23.52.
Additional state fees and increases in the state surcharges for landfill disposal
prompt this increase. The Solid Waste Management Division recommends our rate be
increased to $20.00 per .ton with a $20.00 minimum. Citizens showing a current- water __
bill will still be able to dump normal household waste free.
Currently, Solid Waste Management Division does not accept tires at the City landfill.
The City does not have a fee to accept tires other than charging for them across the
scale as normal waste. Additional disposal costs result when accepting tires. Solid
Waste Management Division does NOT recommend accepting tires at the landfill on a
wholesale basis or otherwise However; Sol-id Waste Management-does recommend- inc-l-ud-i-ng
the possibility of accepting tires in the ordinance for a charge of $2.00 for each
passenger vehicle tire and $5.00 per truck tire. This would make it possible to accept
a household's tires as a special waste.
FISCAL INFORMATION/CERTIFICATION:
It is estimated that landfill revenues will increase $40,000 during FY 91-92 with
adoption of this ordinance. The Customer Service Division/Billing S
