AN ORDINANCE INCREASING THE APPROPRIATIONS IN THE GENERAL FUND, GGO1, CENTER NO 0906601, NON-DEPARTMENTAL/CONTRACT ADMINISTRATION, OF THE CITY OF FORT WORTH FOR FISCAL YEAR 1990-91 BY $78,500.35 AND DECREASING THE UNRESERVED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT, SAID FUNDS TO BE USED FOR THE PURPOSE OF REMOVAL, DISPOSAL AND SITE CLEAN-UP OF SIXTEEN (16) UNDERGROUND STORAGE TANKS AND ASSOCIATED APPURTENANCES; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS• SECTION 1. That in addition to those amounts allocated to the various City departments for the Fiscal Year 1990-91 and in the Budget of the City Manager, there shall also be increased appropriations of 578,500.35 in the General Fund, GGO1, Center No. 0906601, Non-Departmental/Contract Administration, thereby decreasing the unreserved, undesignated fund balance by the same amount, said funds to be used for the purpose of removal, disposal and site clean-up of sixteen (16) underground storage tanks and associated appurtenances. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court or competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. ~: SECTION 3. That this ordinance shall be cumulative of Ordinance No. 10652 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date into the minutes of the City Council and by filing this ordinance in the ordinance records of the City of Fort Worth. SECTION 5. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. RECOMMENDATIONS: It is recommended that City Council take the following action: 1. Adopt the attached supplemental appropriation ordinance increasing appropriation by $78,500.35 in General Fund GGO1, Center No. 0906601, Non-Departmental, Contract Administration, and decreasing the unreserved, undesignated fund balance of the General Fund by the same amount; and 2. Authorize the City Manager to execute a contract with Eagle Construction & Environment Services, Inc. for the removal, disposal and site clean-up of sixteen (16) underground storage tanks and associated appurtenances on the low responsive bid of $78,500.35. DISCUSSION: The underground storage tank (UST) regulations, as adopted by the Texas Water Commission, require removal and site remediation on abandoned and/or leaking underground storage tanks. The City's consulting engineer on underground storage tank compliance identified several UST sites/facilities requiring removal and soil remediation. The sites have been rated according to environmental risk factors, establishing a ,priority ranking system. The sixteen (16) tanks listed below are those identified as requiring immediate attention. Additional sites will be addressed later. Harley Service Center 2 fuel 3 waste oil Holly Water Plant 1 abandoned Inner City Service Center 3 fuel Downtown Service Center 1 waste oil Rockwood Golf Course 1 fuel Southeast Service Center 1 abandoned 1 waste oil Fire Station No. 9 2 fuel Water Service Center 1 waste oil All the above systems will be completely removed and are not scheduled for replacement except for Fire Station No. 9, which will have an above ground system installed. This project will further place the City in compliance with the Texas Water Commission & Environmental Protection Agency underground storage tank regulation. SUBMISSION OF BIDS: On March 14, 1991, the following bids were received: Estimated Time Bidder Amount Bid For Completion Sunbelt Industries $ 76,482.06 39 days Eagle Construction $ 78,500.35 90 days United Construction $130,325.65 48 days Emtech Env. Svcs. $165,470.30 88 days Les Gray Co. $248,107.00 110 days Sunbelt Industries' bid was considered non-responsive as they did not meet two of the requirements for bidders; (1) no bid bond or certified funds for bond accompanied the bid, and (2) no good faith effort was shown on the DBE statement. Eagle Construction was therefore considered the lowest responsive bidder. FINANCING: Upon approval of Recommendation No. 1, sufficient funds will be available in General Fund GGO1, Center No. 0906601, Non Departmental, Contract Administration. Expenditures will be made from .Account No. 539120. The unreserved, undesignated General Fund balance will be $26,341,130 upon completion of this transfer.
