Home My WebLink AboutOrdinance 10841ORDINANCE N0. ~~~~~'~~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING TWO UTILITY EASEMENTS LOCATED WITHIN THE OVERTON WEST ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the two (2) foot wide by eight (8) foot long and the three and three-tenths (3.3) foot wide by twenty-eight (28) foot long portions of utility easements located adjacent to the north property line of Lots 4 and 5, Block F, Overton West Addition, as recorded in Cabinet A, Slides 346 to 348, P.R.T.C.T., and as more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same are vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated utility easements is hereby released and shall revert to the adja- cent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. DISCUSSION: Dunaway Associates, representing the owner of all adjacent property, has requested that the City vacate portions of two utility easements as defined. The easements were acquired by dedication, but do not contain any utility facilities. The vacations are requested in order that the vacated easement can be utilized with the adjacent property. The Director of Real Property Management has determined that a $1.00 consideration fee satisfies the City of Fort Worth's interest in this request. Reviewing City departments and private utility companies have raised no objections to this request. A satisfactory replat has been submitted.
