ORDINANCE N0 . ~D ~~~ AN ORDINANCE AMENDING APPENDIX B, "DEPARTMENT OF CITY SERVICES", OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, BY AMENDING SUBSECTION (C) OF SECTION 11A-8, WEEDS AND BRUSH, HIGH GROWTH AND ACCUMU- LATION PROHIBITED, EXCEPTION; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL ORDINANCES AND PROVISIONS OF THE CODE OF THE CITY OF FORT WORTH IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. Subsection (c) of Section 11A-8 of the Code of the City of Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as follows: "Sec. 11A-8. Weeds and brush, high growth and accumula- tion prohibited, exception. "(c) It shall be unlawful for any person having charge of or control of any property to suffer or permit grass, weeds or any plant that is not cultivated to grow in rank profusion, or otherwise, in or upon the parkway adjacent thereto, or the area between the property line and the edge of the street pavement, to a height greater than twelve (12) inches on an average." SECTION 2 This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. .. .. ., SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, para- graphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sen- tence, paragraph or section. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the cap- tion and effective date in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 5. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. BACKGROUND: The current Code provision requires the person having charge or control of property to maintain the area of the property between the property line and the curb line. The recommended ordinance changes "curb line" to "edge of street pavement".
