HomeMy WebLinkAboutOrdinance 1101 ORDINANCE NO. !�o AN ORDINANCE PROVIDING FOR THE PERMANENT ABANDONMENT, CLOSING AND VACATING OF THE ALLEYS AND ALLEY WAYS IN BLOCKS 241, 242, 243, 244, 245 AND 246 OF THE SUBDIVISION OF THE NORTH FORT WORTH TOWNSITE COMPANY, NORTH FORT WORTH, TEXAS; AND PROVIDING FOR THE FORFEITING OF ALL RIGHT, TITLE, INTEREST AND CLAIM POSSESSED BY THE CITY OF FORT WORTH, TEXAS, IN AND TO SAID ALLEYS AND ALLEY WAYS MENTIONED; AND PROVIDING FOR THE EXECUTION, AOKNOW- LEDGMENT AND DELIVERY OF A QUITCLAIM DEED BY THE CITY OF FORT WORTH, TEXAS TO THE FORT WORTH BASEBALL CLUB, RELEASING AND QUITCLAIMING TO IT, ALL RIGHT, TITLE AND INTEREST OWNED, POSSESSED, CLAIMED AND ASSERTED BY THE CITY OF FORT WORTH IN AND TO SAID ALLEYS AND ALLEY WAYS MENTIONED; AND PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH. WHEREAS, it appears to the City Council of the City of Fort Worth, Texas that Fort Worth Baseball Club, a corporation, duly incorporated under the laws of the State of Texas, is the owner of Blocks 241, 242, 243, 244, 245 and 246 of the Subdivision of the North Fort Worth Townsite Company, North Fort Worth, Texas; and that the plat and dedication of said respective blocks described shows a ten foot alley way running approximately in a northerly and southerly direction through each of said blocks; the west line of said alley ways being approximate- ly 95 feet from the west line of said respective blocks, and the east line of said respective alley ways being approximately 95 feet from the east line of said respective named blocks; and WHEREAS, none of said alley ways have heretofore ever been used by the public; and the continuance of said alleys and alley ways mentioned constitutes a dangerous use and nuisance, and by reason of the foregoing said alley ways should be ordered vacated, closed and per- manently abandoned, and all right of the City of Fort Worth, Texas and the public to the use thereof should be forfeited and abandoned. NOW THERY70RE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: Section 1: That the respective alleys and alley ways running through Blocks 241, 242, 243, 244, 245 and 246 of the Subdivision of the North Fort Worth Townsite Com- pany, North Fort Worth, Texas, as shown by the plat of said subdivision, be and the same are hereby vacated, closed and permanently abandoned as alleys and alley ways; and all right, title and interest owned and possessed by the City-of Fort Worth, Texas and the public in and to said alleys and alley ways running through and across said named blocks be, and the same are hereby surrendered and forfeited to the Fort Worth Baseball Club. Section 2: The City of Fort Worth, Texas, by and through its duly authorized officers, be and they are hereby directed, empowered and authorized, in consider- ation of the sum of $100.00 previously paid by the Fort Worth Baseball Club to the City QQ of Fort Worth, Texas, as set forth in Ordinance No. 4M heretofore adopted, to execute, acknowledge and deliver to the Fort Worth Baseball Club, a corporation, and to its successors and assigns, a quitclaim deed releasing, surrendering and quitclaim- ing to the said Fort Worth Baseball Club, all right, title and interest owned, possessed, claimed or asserted, by the City of Fort Worth, Texas, in and to those alleys and alley ways running through, across and over Blocks 241, 242, 243, 244, 245 and 246 of the Subdivision of the North Fart Worth Townsite Company, North Fort Worth, Texas, herein and hereby ordered forever vacated, closed and abandoned. Section 3: This ordinance shall supplement //oa Ordinance No. SW* heretofore enacted; and all other ordinances and portions of ordinances in conflict here- with are hereby repealed. Section 4: This ordinance shall take effect and be in full force and effect from and after the date of its passage.
