HomeMy WebLinkAboutOrdinance 10843~M APPROPRIATIONS FROM UNRESERVED, UNDESIGNATED RETAINED EARNINGS ORDINANCE NO. }~~ J AN ORDINANCE INCREASING APPROPRIATIONS BY $8,439,400.00 IN THE WASTEWATER OPERATING FUND, PE45, ACCOUNT NO. 539120, CENTER NO. 0705002 AND DECREASING THE UNRESERVED, UNDESIGNATED RETAINED EARNINGS BY THE SAME AMOUNT FOR THE PURPOSE OF EXECUTING A CONTRACT FOR SLUDGE REMOVAL; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for the Fiscal Year 1990-91 and in the Budget of the City Manager, there shall also be increased appropriations in the Wastewater Operating Fund, PE45, Account No. 539120, Center No. 0705002 in the amount of $8,439,400.00; thereby decreasing the unreserved, undesignated Retained Earnings by the same amount, for the purpose of executing contract for sludge removal. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court or competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect . SECTION 3. That this ordinance shall be cumulative of Ordinance No. 10652 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. The City Secretary of the City of Fort worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date into the minutes of the City Council and by filing this ordinance in the ordinance records of the City of Fort Worth. SECTION 5. Ds~~rY This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Adopt the attached supplemental appropriation ordinance increasing appropriations by $8,439,400 (including $244,000 for possible change order and $50,000 project administration) in the Wastewater Operating Fund PE45 Account Number 539120, Center Number 0705002 and decreasing the wastewater unreserved, undesignated retained earnings by an equal amount. 2. Award a contract to Oscar Renda Construction Contracting, Inc. ("Contractor") in the amount of $8,145,400 for Sludge Removal, Dewatering and Disposal at Village Creek Treatment Plant, subject to the contractor submitting to the City of Fort Worth, no later than 5:00 p.m., CDT, Monday, June 3, 1991, evidence satisfactory to the City that the Contractor has been awarded in its name, all necessary permits for the agricultural land application of the sludge. Project Number: PS58-070580160210 DISCUSSION: On May 14, 1990 (M&C C-12329) Alan Plummer and Associates was retained to investigate the alternatives for processing and disposal of sludge due to the buildup of inventory in the sludge drying beds. Engineering analyses completed on November 14, 1990, showed that the present drying beds do not have the capacity to dry the anaerobically digested sludge due to a buildup of inventory over the last two years and due to operating problems with equipment and rutting of beds. On September 25, 1990 (M&C C-12525) Alan Plummer and Associates was authorized to prepare contract documents for operation of a sludge pressing facility at the Village Creek Wastewater Treatment Plant, removal of sludge- from the sludge drying beds and disposal of the sludge from both places by beneficial application on agricultural land. BIDS: On March 14, 1991, bids were received from four bidders for a one-year contract with an option to extend the contract for an additional one year to (1) dewater and dispose of 40 dry tons of sludge at the treatment plant and (2) remove and dispose of sludge from ten of the fifty sludge drying beds. All disposal was specified to be by beneficial application to agricultural land.
