Filey nay of - , 19 Filed--V-•-- nay City Secretary City Secr ORDINANCE NO. 222—2' Q AN ORDINANCE PROVIDING THAT THE ALLEY IN BLOCK 18, ROSS HEIGHTS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE ABANDONED, VACATED AND CLOSED; AND PROVIDING FOR THE REVERSION OF THE FEE TO SAID LAND. SECTION 1. That the alley in Block 18, Ross Heights Addition to the City of Fort Worth, Tarrant County, Texas, is hereby vacated, closed and perma- nently abandoned as an alley or public thoroughfare of any kind or char- acter whatever. SECTION 2. That the fee to the land in said alley above described is hereby released and will revert to the owners as provided by law, save and ex- cept that an easement is reserved for all existing utilities; and it is specifically understood and agreed that should a permanent structure be constructed over any part of the sanitary sewer in said alley, the owners shall, at their own expense, either reroute or replace this line with cast iron pipe. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and ef- fect from and after the date of its passage. SANDERS, doing bu sine s s as United Heat Treating Company, DOUBLE SEAL RING COMPANY, INC. , a corporation, CAIN AND CAIN, contractors, a partnership composed of ROY CAIN and others, C. C. GRIFFIN and HARRY B. FRIEDMAN, hereafter referred to as Petitioners, respectfully petition the City Council to vacate and abandon the alley that runs through Block 18, Ross Heights, an addition to the City of Fort Worth, Tarran County, Texas, and as justification therefor, Petitioners would respectfully show: 1. That Block 18 is zoned as heavy industry; that the owners of said block are all engaged in either the manufacturing or construction business and said block presently has situated an same three heavy industries employ- ing heavy machinery and equipment and the remainder of said block is used as warehouse and storage place for contractors supplies; that there is under contemplation and in the drafting stage improvements in said block that will exceed $200, 000, 00. The Double Seal Ring Company, Inc. , one of the Peti- tioners herein, presently is committed to build on Lots 11 through 19 an additional building and install heavy machinery costing in excess of $100, 000. The6 41 in said block will serve no useful purpose and the public, due to the uses made and the type of structures constructed and to be construct- ed upon said block, will never have any use or benefit from the alley. 2. Due to the contour of the land and the fill or grade for the railroad spur which runs to the back of said alley, there is no practical use for said alley for any public purpose. Adequate access is provided all the industry in said block by Montgomery Street to the West, Gendy Street to the East and Bryce and Byers Streets on the North and mouth. To close and abandon said alley will not affect in any manner the public interest but will encourage the future development and improvement of said block by the building of substan- tial industrial structures thereon thus increasing the taxable revenue to the City of Fort Forth all in the public interest. 3. Petitioners constitute the owners of all of the lots in said block and attached hereto, marked Exhibit "A" and made a part of this petition is a request in writing signed by all the owners of lots in Block 18, Ross Heights an addition to the City of Fort Worth, Texas, in keeping with the requirements of the laws of the State of Texas and the City Ordinances pertaining to the clos ing and abandoning of alleys. WHEREFORE, PREMISES CONSIDERED, your Petitioners respee - fully pray that this Petition be referred to the City Manager and the Honorable Milo Thelin for recommendation and upon final consideration, Petitioners res pectfully pray that said alley be vacated and abandoned.
