AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING TWO UTILITY EASEMENTS LOCATED WITHIN THE FIELDS WELCH ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the five (5) foot wide by approximately one hundred sixty-six (166) foot long utility easement located adjacent to the east property line of Lot 9-R, Block 3, Fields Welch Addition, as recorded in Volume 388-162, Page 91, P.R.T.C.T., as it runs from a point in line with the south property line of Lot A-W, Francis Subdivision, as recorded in Volume 1900, Page 227, P.R.T.C.T., southward to a point in line with the north property line of Lot 3, Stanford Subdivision, as recorded in Volume 388-119, Page 51, P.R.T.C.T., and is adjacent to the west property lines of Lots B and C, Bertha Harmon Subdivision, as recorded in Volume 106, Page 46, P.R.T.C.T., and the ten (10) foot wide by ninety-four point sixty-seven (94.67) foot long utility easement located in the northern portion of Lot 9-R, Block 3, Fields Welch Addition, as recorded in Volume 388-162, Page 91, P.R.T.C.T., lying five (5) feet north and five (5) feet south of a centerline as the centerline runs from a point at the most southeasterly corner of Lot 10-A, Block 3, Fields Welch Addition, as recorded in Volume 388-175, Page 93, P.R.T.C.T., eastward to the east property line of Lot 9-R, Block 3, Fields ~; „~;~ -L Welch Addition, which is also the west property line of Lot B, Bertha Harmon Subdivision, as recorded in Volume 106, Page 46, P.R.T.C.T., and as both said utility easements are more spe- cifically described in attached Exhibit "A", attached hereto and incorporated herein, are hereby released and shall revert to the adjacent owner as provided by law. SECTION 2. That the fee to the land in the above described vacated utility easements is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY: ~. DISCUSSION: Dr. John L. Nugent, owner of the subject property, has requested that the City vacate these utility easements. Although the easements contain electric and telephone lines, an acceptable arrangement has been made with the respective companies for relocation of these utilities. Reviewing City departments and private utility companies have raised no objections to this request. A one-dollar fee satisfies the interest of the City of Fort Worth in the subject vacation. This property is located in Council District 8.
