HomeMy WebLinkAboutOrdinance 21978-12-2015 ORDINANCE NO. 21978-12-2015 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $340,000.00, SUBJECT TO RECEIPT OF A GRANT FROM THE TEXAS DIVISION OF EMERGENCY MANAGEMENT FOR THE PURPOSE OF REIMBURSING CITIES FOR CONDUCTING EMERGENCY MANAGEMENT PLANNING AND PREPAREDNESS ACTIVITIES THROUGH THE EMERGENCY MANAGEMENT PERFORMANCE GRANT (EMPG); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of$340,000.00, subject to receipt of a grant from the Texas Division of Emergency Management for the purpose of reimbursing cities for conducting Emergency Management Planning and Preparedness activities through the Emergency Management Performance Grant(EMPG). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 21873-09-2015 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the Office of Emergency Management to apply for the Fiscal Year 2016 Emergency Management Performance Grant from the Texas Division of Emergency Management in the approximate amount of up to $170,000.00 to reimburse expenditures from the City's Emergency Management program; 2. If awarded the grant: a. Authorize the acceptance and execution of a grant contract with the Texas Division of Emergency Management in the amount of the award, which is estimated to be in an amount of up to $170,000.00; b. Authorize the transfer of the Office of Emergency Management funds from the General Fund to the Grants Operating Federal Fund in an amount of up to $170,000.00 as the City's match for the grant; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of$340,000.00, subject to receipt of a grant from the Texas Division of Emergency Management. DISCUSSION: The Texas Division of Emergency Management provides funds to reimburse cities for conducting Emergency Management Planning and Preparedness activities through the Emergency Management Performance Grant (EMPG). The City anticipates receiving an award estimated in the amount of up to $170,000.00 from the Fiscal Year (FY) 2016 EMPG Program based upon FY2003 - FY2015 awards. Approval of this Mayor and Council Communication will authorize the Office of Emergency Management to apply for a FY2016 EMPG Grant. Additionally, approval will also authorize acceptance of the EMPG award and transfer of the City's match in the amount of up to $170,000.00 from the approved FY2016 General Fund Budget to the Grants Fund. Logname: 36EMPG2016 Page 1 of 2 FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations, receipt of the grant and adoption of the attached appropriation ordinance, funds will be available in the operating budget, as appropriated, of the General Fund and Grants Operating Federal Fund. The FY2016 Budget included appropriations of$144,426.00 in the General Fund for this purpose. To date, $0.00 of the appropriations have been expended. If awarded, the department will identify the additional $25,574.00 needed to complete the City's $170,000.00 obligation. Upon approval of this recommendation, the Financial Management Services Director certifies that funds are available within the existing appropriations for this expenditure.
