HomeMy WebLinkAboutOrdinance 21980-12-2015 ORDINANCE NO.21980-12-2015 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS OPERATING FEDERAL FUND IN THE AMOUNT OF $3,082,557.64, SUBJECT TO RECEIPT OF A GRANT FROM THE HOMELAND SECURITY FROM THE STATE OF TEXAS, OFFICE OF THE GOVERNOR, FOR THE PURPOSE OF ENHANCING LOCAL CAPABILITIES TO PREVENT,RESPOND TO AND RECOVER FROM ACTS OF TERRORISM AND NATURAL DISASTERS; PROVIDING FOR A SEVERABILITY CLAUSE; MAYdNG THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Operating Federal Fund in the amount of$3,082,557.64, subject to receipt of a grant from the Homeland Security from the State of Texas, Office of the Governor, for the purpose of enhancing local capabilities to prevent, respond to and recover from acts of terrorism and natural disasters. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 21873-09-2015 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Logname: 362015HSGP.V2 Page 1 of 3 DISCUSSION: The United States Department of Homeland Security (DHS) through the State of Texas, Office of the Governor awards grants to jurisdictions across the state to enhance local capabilities to prevent, respond to and recover from acts of terrorism and natural disasters. The Homeland Security Grant Program (HSGP) encourages jurisdictions to strengthen local and regional preparedness efforts and to seek benefits available through cooperative action. Funding awarded as part of the 2015 Urban Area Security Initiative (UASI) and HSGP will be used by Fort Worth public safety and disaster support organizations to maintain and improve the community's capacity to prepare for, prevent and respond to terrorism incidents and other natural disasters. Fort Worth has been offered the opportunity to participate in the HSGP State Homeland Security Program (SHSP) and UASI program each year since 2005, receiving over $28,000,000.00 in grant funds to supplement local and regional preparedness efforts. The Office of Emergency Management coordinates with City departments in the development and implementation of grant funded projects in the areas of threat assessment, risk reduction, capability sustainment, plan development, public education and training. Indirect costs are allowable under this program as described in 2 C.F.R. § 200.414. With the exception of recipients who have never received a negotiated indirect cost rate as described in 2 C.F.R. § 200.414(f), recipients must have an approved indirect cost rate Agreement with their cognizant Federal agency to charge indirect costs to this award. A copy of the approved rate (a fully executed Agreement negotiated with the applicant's cognizant Federal agency) is required at the time of application and must be provided to DHS/FEMA before indirect costs are charged to the award. At the time of application, the City did not have an indirect cost rate Agreement or a letter of renewal. Therefore, indirect costs were not included in the City's application. This grant has no local match requirement. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations, receipt of the grant and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Operating Federal Fund. Funds will be reimbursed by grantor after expenditures are made. Specific account, project and activity identifiers will be created upon receipt of grant funds. The Fire Department will be responsible for the collection and deposit of funds due to the City. Prior to expenditure being made, the Fire Department has the responsibility to validate the availability of funds.
