AN ORDINANCE INCREASING THE APPROPRIATIONS IN THE GENERAL FUND, GGOI, CONSULTANTS-LEGAL, ACCOUNT NO 531200, NON-DEPARTMENTAL, CENTER NO 0905512 OF THE CITY OF FORT WORTH FOR FISCAL YEAR 1990-91 BY $14,370 95 AND DECREASING THE UNRESERVED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT SAID FUNDS TO BE USED FOR THE PURPOSE OF EMPLOYMENT OF JOSEPH COLVIN AND FIRM OF GILBERT & COLVIN AS OUTSIDE COUNSEL TO REPRESENT THE CITY IN A PENDING BANKRUPTCY CASE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH;- PROVIDING FOR ENGROSSMENT AND ENROLLMENT, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1990-91 and in the Budget of the City Manager, there shall also be increased appropriations of $14,370 95 in the General Fund, GGO1, Consultants-Legal, Account No. 531200, Non-Departmental, Center No 0905512, thereby decreasing the unreserved, undesignated fund balance by the same amount said funds to be used for the purpose of employment of Joseph Colvin and the firm of Gilbert & Colvin as outside legal counsel to consult with and represent the City in a pending bankruptcy case SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court or competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect r. ~ ';: r E f ~ a SECTION 3. That this ordinance shall be cumulative of Ordinance No. 10652 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date into the minutes of the City Council and by filing this ordinance in the ordinance records of the City of Fort Worth. SECTION 5. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Adopt the attached Resolution increasing to $22,197.85 the total amount authorized to be paid to Joseph Colvin and the firm of Gilbert & Colvin for their services pertaining to the Briscoe bankruptcy proceedings; and 3. Authorize payment of $14,370.95 to Joseph Colvin and the firm of Gilbert & Colvin for their services through March 19, 1991. DISCUSSION• The City Council has previously authorized the employment of Joseph Colvin and the firm of Gilbert & Colvin as outside legal counsel to consult with and represent the City in a pending bankruptcy case concerning Briscoe Enterprises, Ltd., II and Briscoe Enterprises, Ltd III (M&C No. G-8452 dated February 6, 1990). The City has previously paid Mr. Colvin the sum of $7,826.90 for services through May 30, 1990. The total amount presently due and owing to Mr. Colvin for his services through March 19, 1991, is $14,370.95 and should be paid. FINANCING: sufficient funds will be available in the Upon approval of the recommendation , General Fund GGO1, Center No. 0905512 Consultants-Legal. The expenditure will be made from Account No. 531200.
