HomeMy WebLinkAboutOrdinance 10961 ORDINANCE N0. l/ ~~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING THREE UTILITY EASEMENTS LOCATED IN BLOCK 104-R, RIDGMAR ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONF- LICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following utility easements located in Block 104-R, Ridgmar Addition, be and the same are vacated, abandoned and permanently closed and extinguished: (1) A 10 foot wide by approximately 236 feet long utility easement located in the northwest corner of the subject property; (2) A 15 foot wide by approximately 848.5 feet long utility easement located in the north portion of the subject property; and (3) A 10 foot wide by approximately 261.2 feet long utility easement located in the northeast corner of the subject property. These three utility easements are recorded in the plat of Block 104-R, Ridgmar Addition, as recorded in Volume 388-204, Page 47, P.R.T.C.T., and are more specifically described in Exhibit "A" and shown on Exhibit "B", both of said exhibits being attached hereto and incorporated herein. SECTION 2. That the fee to the land in the above described vacated utility easements is hereby released and shall revert to the adja- cent owner as provided by law. ~. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. A 10 foot wide by approximately 236 feet long utility easement located in the northwest corner of the subject property, and 2. A 15 foot wide by approximately 848.5 feet long utility easement located in the north portion of the subject property, and 3. A 10 foot wide by approximately 261.2 feet long utility easement located in the northeast corner of the subject property. These three utility easements are recorded in the plat o f Block 104-R, Ridgmar Addition, as recorded in Volume 388-204, Page 47, P.R.T.C.T. DISCUSSION: Woodmont Corporation, owner of all adjacent properties, has requested that the City vacate the three above-described utility easements in order to facilitate a pending commercial development opportunity. The easements do not contain any utility facilities. Reviewing City departments and private utility companies have raised no objections to this request. An acceptable replat has been submitted. This property is located in Council DISTRICT 3. FISCAL INFORMATION/CERTIFICATION: A one dollar fee satisfies the interest of the City of Fort Worth in these utility easements.
