HomeMy WebLinkAboutOrdinance 10962i:!' . t .A ~~ k„ y ORDINANCE NO ~~~~ .i~~ AN ORDINANCE APPROPRIATING $534,033 TO THE GENERAL FUND AND DECREASING THE UNRESTRICTED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT FOR THE PURPOSE OF FUNDING A LETTER OF AGREEMENT FOR PROFESSIONAL ASSISTANCE, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, PROVIDING FOR ENGROSSMENT AND ENROLLMENT, AND PROVIDING AN EFFECTIVE DATE. BE TT ORDAINED BY THE CITY COUNCII. OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1991-92 and in the Budget of the City Manager, there shall also be increased appropriations in the General Fund in the amount of $534,033, thereby decreasing the unrestricted, undesignated Fund Balance by the same amount, for the purpose of funding a letter of agreement for professional assistance to obtain an EPA storm water permit with the North Central Texas Council of Governments (NCTCOG). SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 10892 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are m direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and effective date into the minutes of the City Council and by filing this ordinance in the ordinance records of the City of Fort Worth: SECTION 5 This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Adopt the attached supplemental appropriation ordinance increasing appropriations by $534,033 in the General Fund and decreasing the unreserved undesignated fund balance of the General Fund by the same amount, and 2. Authorize the City Manager to execute a letter of agreement for professional assistance to obtain an EPA storm water permit with the North Central Texas Council of Governments (NCTCOG) for an amount not to exceed $534,033, over a two- year period.. DISCUSSION: The Federal Water Quality Act of 1987 and regulations published on November 16, 1990 required seven (7) cities, including Fort Worth to submit a storm water permit application by November 1992 for controlling the quality of storm water discharges. City staff has completed Part I of the application by utilizing existing resources, however, due to the complexity and limited time required to complete Part II of the permit application, the need for outside assistance is necessary. The North Central Texas Council of Governments with the assistance of the Regional Urban Storm Water Management Task Force, developed a program with the U. S. Geological Survey to assist the affected cities in the metroplex in meeting the technical requirements for wet weather sampling. In addition, the NCTCOG and the Task Force selected an engineering firm to further assist in completing Part II of the permit application. Staff has reviewed the cost associated with the services being provided under the letter of agreement and find them to be a reasonable and cost effective means to provide the technical resources necessary to complete Part II of the storm water permit process.
