AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING AN EMERGENCY ACCESS AND UTILITY EASEMENT LOCATED WITHIN THE WESTERN TECHNICAL AND MANAGEMENT CENTER ADDITION TO THE CITY OF FORT WORTH; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the emergency access and utility easement known as Eddie Chiles Court as it runs eastward from Lou Menk Drive to its termination, and located within Lot 1R1,Block 1, Western Technical and Management Center Addition, and as recorded in Volume 388-143, Pages 94 and 95, P.R.T.C.T., and as more spe- cifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated emer- gency access and utility easement is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT the utility easement provided on the plat of the property which crosses the emergency access and utility easement and which con- tains a twelve (12) foot sewer line is retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. i SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. COMMENCING at the centerline intersection of Lou Menck Drive (formerly Eddie Chiles Boulevard) and the south property line of Western Technical and Management Center being the north right-of-way of Western Center Boulevard; DISCUSSION: The Western Technical and Management Center is proposed to be subdivided and replatted for industrial and corporate offices as an industrial park. The existing facilities at the eastern most end of the property are proposed to be replatted and used by the Burlington Northern Railroad. An existing emergency access easement (private street) is proposed to be vacated in total at its beginning at Lou Menk Drive. The vacated emergency access and utility easement will be retained as a private drive serving the existing facility. This easement does not contain any utility facilities. containing a 12' sewer line will not be affected by this A separate utility easement action. No objection to the vacation of this emergency access and utility easement have been raised by utility companies.
