AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING
ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE
NO. 3011, A5 AMENDED, CODIFIED AS APPENDIX "A" OF THE
CODE OF THE CITY OF FORT WORTH, TEXAS (1986), AS
AMENDED, BY AMENDING SECTION 20 - BOARD OF ADJUSTMENT
TO PROVIDE FOR THE APPOINTMENT OF FOUR ALTERNATE
MEMBERS TO THE BOARD INSTEAD OF THE PRESENT TWO AND TO
PROVIDE FOR THE ELECTION OF OFFICERS AT THE NOVEMBER
MEETING EACH YEAR INSTEAD OF EVEN NUMBERED YEARS;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS
CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT;
PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING A
PENALTY; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWS-
PAPER; AND PROVIDING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That Section 20, "BOARD OF ADJUSTMENT" of the Comprehensive
Zoning Ordinance, being Ordinance No. 3011, as amended, codified
as Appendix "A" of the Code of the City of Fort Worth, Texas
(1986), as amended, is hereby amended by amending the following
sections to read as follows:
A. Organization of the Board:
1. Creation and Appointment:
There is hereby created a Board of Adjustment
of the City of Fort Worth, Texas, to be com-
posed of five (S) members and four (4) alter-
nate members who shall be qualified electors
of the City of Fort Worth. It is the
declared policy that the City Council will
consider for appointment to the Board of
Adjustment only those persons who have demon-
strated their civic interest, general knowl-
edge of the community, independent judgment,
understanding of zoning and planning and
availability to prepare for and attend
meetings. Preference will be given, where
feasible, to appointees who possess knowledge
or background in one of the following fields:
a) Law
b) Property Development
c) Building Design
d) Mortgaging and Financing
2. Terms of Office:
The terms of five (5) of the members shall
expire on October 31 of each odd numbered
year and the terms of four (4) of the members
shall expire on October 31 of each even num-
bered year. The members of the Board shall
be identified by place numbers one (1)
through nine (9). The odd-numbered places
shall expire in the odd-numbered years and
the even-numbered places shall expire in the
even-numbered years. Board members may be
appointed to succeed themselves. Vacancies
shall be filled for unexpired terms but no
member shall be appointed for a term in
excess of two (2) years.
3. Organization:
The Board shall hold an organizational
meeting in November of each year and shall
elect a chairman and vice-chairman from among
its members before proceeding to any other
matters of business. The Development
Director of the City of Fort Worth, or his
designated representative, shall be the
secretary of the Board. The Board shall meet
regularly and shall designate the time and
place of its meetings. The Board shall adopt
its own rules of procedure and keep a record
of its proceedings in accordance with the
state statutes and this ordinance and the
charter of the City of Fort Worth. Newly
appointed members shall be installed at the
first regular meeting after their appoint-
ment.
SECTION 2.
This ordinance shall be cumulative of all provisions of ordi-
nances and of the Code of the City of Fort Worth, Texas (1986),
as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinances and such

Code, in which event conflicting provisions of such ordinances
and such Code are hereby regealed.
SECTION 3.
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and, if any phrase,
clause, sentence, paragraph or section of this ordinance shall be
declared unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences, para-
graphs and sections of this ordinance, since the same would have
been enacted by the City Council without the incorporation in
this ordinance of any such unconstitutional phrase, clause, sen-
tence, paragraph or section.
SECTION 4.
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and, if any phrase,
clause, sentence, paragraph or section of this ordinance shall be
declared unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such- unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences, para-
graphs and sections of this ordinance, since the same would have
been enacted by the City Council without the incorporation in
this ordinance of any such unconstitutional phrase, clause, sen-
tence, paragraph or section.

SECTION 5.
The City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the
caption, penalty clause and effective date in the minutes of the
City Council and by filing the ordinance in the ordinance records
of the City.
SECTION 6.
The City Secretary of the City of Fort worth, Texas, is
hereby authorized to publish this ordinance in pamphlet form for
general distribution among the public, and the operative provi-
sions of this ordinance as so published shall be admissible in
evidence in all courts without further proof than the production
thereof, as provided in Chapter XXV, Section 3, of the Charter of
the City of Fort Worth, Texas.
SECTION 7.
Any person, firm or corporation who violates, disobeys,
omits, neglects or refuses to comply with or who resists the
enforcement of any of the provisions of this ordinance shall be
fined not more than Two Thousand Dollars ($2,000.00) for each
offense. Each day that a violation is permitted to exist shall
constitute a separate offense.
SECTION 8.
The City Secretary of the City of Fort Worth, Texas, is
hereby directed to publish the caption, penalty clause and effec-
tive date of this ordinance for two (2) days in the official news-
paper of the City of Fort Worth, Texas, as authorized by Section
52.013, Texas Local Government Code.

SECTION 9.
This ordinance shall be in full force and effect from and
after its passage and publication as required by law, and it is
so ordained.
