ORDINANCE NO. D
AN ORDINANCE AMENDING THE FORT WORTH PLUMBING CODE,
CODIFIED AS CHAPTER 26 OF THE CODE OF THE CITY OF FORT
WORTH (1986), AS AMENDED, BY ADDING SECTION 912 -
WHIRLPOOL BATHTUBS, AND SECTION 913 - WATER CONSERVA-
TION FIXTURES, TO SECTION 26-2(c); PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PRO-
VIDING FOR A SEVERABILITY CLAUSE; PROVIDING FOR A
SAVINGS CLAUSE; PROVIDING FOR A PENALTY CLAUSE; PRO-
VIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR
PUBLICATION IN THE OFFICIAL NEWSPAPER; PROVIDING FOR
ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That Section 26-2(c) of the Code of the City of Fort Worth
(1986), as amended, is hereby amended by adding Section 912 -
Whirlpool Bathtubs, to read as follows:
Section 912 - Whirlpool Bath Tubs.
Unless otherwise listed, all whirlpool bathtubs shall
comply with the following requirements:
(a) A removable panel of sufficient dimension shall be
provided to access the pump.
(b) The circulation pump shall be located above the
crown weir of the trap.
(c) The pump and the circulation piping shall be self-
draining to minimize water retention.
(d) Suction fittings on whirlpool bathtubs shall comply
with the listed standards.
SECTION 2.
That Section 26-2(c) of the Code of the City of Fort Worth
(1986), as amended, is hereby amended by adding Section 913 -
Water Conservation Fixtures, to read as follows:

Section 913 - Water Conservation Fixtures.
Discharge Flow Rates/Water Consumption.The maximum flow
rate of plumbing fixture/fittings at a working pressure
of 80 psi shall be as follows:

Lavatory Faucet
Public Lavatory Faucet
(other than metering)
Metering Faucet
Sink Faucet
Showerhead
Urinals
Water Closets
SECTION 3.
3.0 gpm
0.5 gpm
0.25 gal/cycle
3.0 gpm
3.0 gpm
1.5 gal/flush
3.5 gal/flush
This ordinance shall be cumulative of all provisions of ordi-
nances and of the Code of the City of Fort Worth, Texas (1986),
as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances
and such Code are hereby repealed.
SECTION 4.
It is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and, if any phrase,
clause, sentence, paragraph or section of this ordinance shall be
declared unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences, para-
graphs and sections of this ordinance, since the same would have
been enacted by the City Council without the incorporation in
this ordinance of any such unconstitutional phrase, clause, sen-
tence, paragraph or section.

SECTION 5.
All rights and remedies of the City of Fort Worth, Texas,
are expressly saved as to any and all violations of the provi-
sions of Chapter 26 of the Code or any other ordinances affecting
plumbing which have accrued at the time of the effective date of
this ordinance; and, as to such accrued violations and all
pending litigation, both civil and criminal, whether pending in
court or not, under such ordinances, same shall not be affected
by this ordinance but may be prosecuted until final disposition
by the courts.
SECTION 6.
Any person, firm or corporation who violates, disobeys,
omits, neglects or refuses to comply with or who resists the
enforcement of any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall
be punishable by a fine not to exceed Two Thousand Dollars
($2,000.00) for all violations involving fire safety or public
health and sanitation and shall be fined not more than Five
Hundred Dollars ($500..00) for all other violations of this ordi-
nance.
SECTION 7.
The City Secretary of the City of Fort worth, Texas, is here-
by authorized to publish this ordinance in pamphlet form for
general distribution among the public, and the operative provi-
sions of this ordinance as so published shall be admissible in
evidence in all courts without further proof than the production
thereof, as provided in Chapter XXV, Section 3, of the Charter of
the City of Fort Worth, Texas.

SECTION 9.
The City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the cap-

filing the ordinance in the ordinance records of the City.
SECTION 10.
This ordinance shall be in full force and effect from and
after its passage and publication as required by law, and it is
so ordained.

CT AMENDMENT TO THE FORT WORTH PLUMBING CODE-ORDINANCE N0. 9918
RECOMMENDATION:
It is recommended that the City Council amend the Plumbing Code of the City of Fort
Worth and adopt the new additions as presented.
DISCUSSION:
The Plumbing Board is requesting that the Plumbing Code be amended as follows:
1. Add anew Section 912 which reads:
