HomeMy WebLinkAboutOrdinance 10984ORDINANCE N0. /~C~~se~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A STREET RIGHT-OF-WAY LOCATED WITHIN THE SEMINARY HILL ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PRO- VIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the portion of the street right-of-way of Martin Lydon Street located between Lot 12R, Block 24, Seminary Hill Addition, as recorded in Volume 388-116, Pages 30 and 31, P.R.T.C.T., and Block 25R, Seminary Hill Addition, as recorded in Volume 388-60, Page 4, P.R.T.C.T., as it runs from the east right-of-way line of the Gulf, Colorado and Santa Fe Railroad easterly to the west right-of-way line of Warren Street, and as more specifically described in attached Exhibit "A", attached hereto and incorpo- rated herein, be and the same is vacated, abandoned and perma- nently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated street right-of-way is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Railroad and the west right-of-way line of Warren Street, as approved by the City Plan Commission. DISCUSSION: The Southwestern Baptist Theological Seminary, owner of all adjacent property, has requested that the City vacate the remaining portion of Martin Lydon Street as described above for the expansion of existing facilities. A satisfactory replat has been submitted which includes the dedication of utility easements acceptable for the retention of existing electric utility facilities. City departments and private utilities have raised no objection to the vacation of this public right-of-way. FISCAL INFORMATION/CERTIFICATION• A one dollar fee satisfies the interest of the City in the subject vacation. This application is located in Council DISTRICT 6.
