AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING AN ALLEY RIGHT-OF-WAY AND A TEMPORARY ACCESS EASEMENT LOCATED WITHIN THE SEMINARY HILL ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CON- FLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the fifteen (15) wide alley right-of-way located between Lots 1 through 5 and 18 through 22, Block 6, Seminary Hill Addition, as it runs from the south property lines of Lots 5 and 18 northward to the south right-of-way line of Gambrell Street, as recorded in Volume 310, Page 45, P.R.T.C.T., and the twenty (20) foot wide temporary access easement located on Lot 11R, Block 6, Seminary Hill Addition, as recorded in Volume 388-150, Page 22, P.R.T.C.T., and located adjacent to the south property line of Lot 18, Block 6, Seminary Hill Addition, as recorded in Volume 310, Page 45, P.R.T.C.T., and as both said alley right-of-way and temporary access easement are more spe- cifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same are vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated alley right-of-way and temporary access easement is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities. ,, x ~ •: SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed.. SECTION 4. DISCUSSION: The Southwestern Baptist Theological Seminary, owner of all adjacent property, has requested that the City vacate the above-described 15' wide alley and 20' wide temporary access easement for the purpose of expanding existing facilities. A satisfactory replat has been submitted which includes the dedication of utility easements acceptable for the retention of existing utility facilities. Reviewing City departments and private utility companies have raised no objection to the vacation of this public right-of-way and temporary access easement. FISCAL INFORMATION/CERTIFICATION: A fee of $2,663.00 satisfies the interest of the City in the subject vacation. This application is located in Council District 6.
