HomeMy WebLinkAboutOrdinance 10986~~'.. le+ "'~ ORDINANCE N0. ~~~L~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING AN ALLEY RIGHT-OF-WAY AND A PORTION OF A STREET RIGHT-OF-WAY LOCATED WITHIN THE SEMINARY HILL ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the fifteen (15) foot wide by six hundred fifty-eight point ninety-seven (658.97) foot long alley right-of-way located between the east right-of-way line of the Gulf, Colorado & Santa Fe Railroad and the west property line of Lots 1 through 10, Block 4, Seminary Hill Addition, as recorded in Volume 388-81, Page 46, P.R.T.C.T., and the triangular portion of the street right-of-way of Broadus Avenue, located along the north property line of Lot 1, Block 4, Seminary Hill Addition, and between the east right-of-way line of the Gulf, Colorado & Santa Fe Railroad and the west line of the street right-of-way of Frazier Avenue, as recorded in Volume 388-81, Page 46, P.R.T.C.T., and as both said alley right-of-way and said portion of street right-of-way are more specifically described in attached Exhibit "A", attached hereto and incorporated herein, be and the same are vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated alley right-of-way and street right-of-way is hereby released and shall revert to the adjacent owner as provided by law. •a SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Railroad right-of-way and Lots 1 through 10, Block 4, Seminary Hill Addition, recorded in Volume 388-81, Page 46, P.R.T.C.T., and a triangular portion of Broadus Avenue located north of Lot 1, Block 4, Seminary Hill Addition and between the east right-of-way line of the G.C. and S.F. Railroad and the west right-of-way line of Frazier Avenue, as recorded in Volume 388- 81, Page 46, P.R.T.C.T., as recommended by the City Plan Commission. DISCUSSION: The Southwestern Baptist Theological Seminary, owner of all adjacent property, has requested that the City vacate the above-described alley and street right-of-way adjacent to their property for expansion of their facilities. A satisfactory replat has been submitted which includes the dedication of utility easements acceptable for the retention of existing utility facilities. City departments and private utility companies have raised no objection to the vacation of these public rights-of-way. FISCAL INFORMATION/CERTIFICATION: A one dollar fee satisfies the interest of the City in the subject vacations. This application is located in Council DISTRICT 6.
