HomeMy WebLinkAboutOrdinance 10993ORDINANCE N0. ~~~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTINGUISHING A STREET RIGHT-OF-WAY LOCATED WITHIN HOLLOWAY'S ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the unnamed street right-of-way located adjacent to Lot 10, Block 4, and Lot 10, Block 5, Holloway's Addition, as recorded in Volume 310, Page 87, P.R.T.C.T., and as more specifi- cally described in attached Exhibit "A", attached hereto and incorporated herein, be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated street right-of-way is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. 1 SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. DISCUSSION: Texas Cold Storage, Ltd., owner of all adjacent property, requested that the City vacate this portion of an unnamed street (delineated in the attached field notes). This street right-of-way is an unvacated portion of a previously vacated right-of-way which runs parallel to the Santa Fe Railroad at the east end of East North Tenth Street and Prosser Street. The vacated right-of-way is undeveloped and does not contain any utility facilities and is proposed to be used for further development of the adjacent property Reviewing City departments and private utility companies have raised no objections to this request. A satisfactory replat has been submitted. This request is located in Council DISTRICT 2. FISCAL INFORMATION/CERTIFICATION: The Land Agent for the City of Fort Worth has determined that a one dollar fee satisfies the interest of the City in this request due to the undeveloped nature of the street right-of-way.
