ORDINANCE NO. D
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-~
GUISHING A STREET RIGHT-OF-WAY LOCATED WITHIN THE ELM
CREEK ESTATES ADDITION; PROVIDING FOR REVERSION OF FEE
IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HERE-
WITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
THAT the one hundred twenty (120) foot wide unnamed street
right-of-way located between Lots 5 and 6 and Lots 10 and 11,
Block 1, Elm Creek Estates Addition, as recorded in
Volume 388-195, Page 12, P.R.T.C.T., and as more specifically
described in attached Exhibit "A", attached hereto and incorpo-
rated herein, be and the same is vacated, abandoned and perma-
nently closed and extinguished.
SECTION 2.
That the fee to the land in the above described vacated
street right-of-way is hereby released and shall revert to the
adjacent owner as provided by law, SAVE AND EXCEPT that easements
are retained for any and all existing and prospective utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict here-
with are hereby repealed.

That this ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so
ordained.

SUBJECT VACATION OF A STREET RIGHT-OF-WAY: ELM CREEK ESTATES ADDITION BLOCK 1, LOTS
5 6 10 & 11 UNNAMED STREET BISECTING ELM CREEK WAY V-91-21
RECOMMENDATION:
It is recommended that the City Council adopt the attached ordinance vacating a 120'
wide street right-of-way reservation bisecting Lots 5, 6, 10 & 11 of block 1, Elm Creek
Estates Addition as recorded in Volume 388-195, Page 12, P.R.T.. C.T. as approved by the
City Plan Commission.
DISCUSSION:
The owners of the above properties have requested that the City vacate a 120' wide
public right-of-way established for the future development of a principal arterial
The principal arterial was identified on the Master Thoroughfare Plan approved at the
time the subdivision was platted. Its location has since been relocated on the 1990
Master Thoroughfare Plan. This street right-of-way reservation is no longer necessary.
A suitable replat has been submitted which retains all required utility easements and
street rights-of-way. The City Plan Commission held a hearing on May 29, 1991 and
approved the vacation. The portion of the street right-of-way proposed for vacation
is undeveloped. Reviewing City Departments have no objection to the vacation of this
public right-of-way and an acceptable replat has been submitted.
This street right-of-way vacation is outside of the City of Fort Worth in the Extra-
Territorial Jurisdiction.
FISCAL INFORMATION/CERTIFICATION:
A fee of one dollar satisfies the interest of the City in the subject vacation.
