HomeMy WebLinkAboutOrdinance 107011 ~ ORDINANCE N0 . ~~ AN ORDINANCE SPECIFYING THE: ADJUSTED TOTAL NUMBER OF AUTHORIZED CIVIL SERVICE POSITIONS AT EACH RANK IN THE FIRE DEPARTMENT; DELETING ONE CAPTAIN'S POSITION AND ONE LIEUTENANT'S POSITION FROM THE TOTAL AUTHORIZED .MANPOWER; PROVIDING THE STATEMENT OF INTENT TO DELETE NINE MORE POSITIONS OF VARIOUS RANKS FROM THE TOTAL AUTHORIZED MANPOWER AT A LATER DATE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERA- BILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT OF THIS ORDINANCE; PROVIDING AN EFFECTIVE DATE. BE IT HEREBY KNOWN: WHEREAS, the Fire Chief has requested the City Council to readjust and thereafter specify the total authorized number of civil service positions at each rank in the Fire Department for the remainder of the 1990-91 Fiscal Year; and WHEREAS, the City's annual budget ordinance for the fiscal year of 1990-91 authorized and budgeted positions for the Fire Department's civil service staffing as follows: Deputy Chiefs 6 District Chiefs 17 Captains 80 Lieutenants 102 ,r Engineers 165 Firefighters 328 Total 698 WHEREAS, on October 2, 1990, an ordinance was enacted which deleted two (2) more Captains' positions, further reducing the total number of Captains' positions to seventy-eight (78) as well as the total authorized strength to 696. WHEREAS, it is now recommended that the City Council autho- rize the immediate deletion of o:ne (1) Captain's position and one (1) Lieutenant's position from the total authorized manpower within the Department. Specifically, there is presently one vacant Captain's position and one vacant Lieutenant's position for which there are no current promotional eligibility lists in effect regarding said vacancies. Due to organizational changes being implemented within the Department, the duties of said posi- tions are being redistributed among other existing positions. Therefore, the said two positions are no longer necessary to achieve the efficient operations of the Fire Department; and WHEREAS, in previous communications, as well as in previous Ordinances, the City Manager's office and the Fire Chief expressed the intent to reorganize certain positions within the Fire Department, meaning that from time to time, and as normal attrition from the Department occurred, certain positions being occupied by civil service personnel would be removed from the classified service by ordinance while at the same time the Department would maintain efficient operations by redistributing those duties to other personnel. This intent was expressed as being in the best interests of the Fire Department and the City of Fort Worth in providing the citizens of Fort Worth the most efficient fire protection possible at the lowest expense neces- sary. Therefore, it is now recommended that the City Council continue to express in specific i~erms the intent and prior notice to delete and abolish an additional nine (9) civil service posi- tions between the effective date of this ordinance up through or by March 31, 1991. It is further recommended that this intent be 2 1 clearly expressed so as to negate any expectancy for promotion into said positions which will be deleted as vacancies occur; and WHEREAS, it is anticipated that due to proposed realignments in the management structure and organization of the Department there will be positions presently occupied by the ranks from Engineer up through Captain which will be deleted. It is pro- posed that said positions be deleted from the civil service of the Department from time to time as vacancies occur, primarily from normal attrition from the Department; and WHEREAS, the Chief of the Fire Department now requests that the Council adjust the authorized. number of Fire Department civil serve positions into conformity with the proposed changes as set forth immediately above in order to effect efficient economy of the operations of the City's municipal services; and WHEREAS, the specification a.nd authorization by ordinance of the correct number of authorized civil service positions is a statutory requirement; NOW, THERE:EORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That effective immediately upon passage of this ordinance, the following positions are th.e only civil service positions authorized in the City of Fort Worth Fire Department until a sub- sequent ordinance is enacted to modify said authorized positions: 3 1 Deputy Chiefs 6 District Chiefs 17 Captains 77* Lieutenants 101** Engineers 165 Firefighters 328 Total 694 *Deletes one Captain's posit~.on. **Deletes one Lieutenant's position. SECTION 2. That as the following positions become vacant through normal attrition from the Department, or as said positions become no longer a necessity due to reorganization of the Department, these shall be deleted and abolished from the total authorized manpower of the Department: Captains Lieutenants Engineers Firefighters Total To Be Deleted 1 2 5 1 9 SECTION 3. This ordinance shall be cumulative of all provisions of pre- vious ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this staffing ordinance are in direct conflict with the provisions of such ordi- nances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. The "Mayor and Council Communication" memorandum of /0 23 90 ~~ reference No. G~ 88~1O is hereby expressly incorpo- rated herein by reference for further clarification and explana- tion of the purpose and intent of the Council in their adoption of this ordinance. 4 '~ SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, para- graphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sen- tence, paragraph or section. SECTION 5. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the cap- tion and effective date in the minutes of the City Council and by filing the ordinance in the ordinance records of the City of Fort Worth, Texas SECTIC>N 6 This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. ARTMFNT - ~~ ~ RECOMMENDATION: It is recommended that the City Council adopt the attached ordinance to immediately decrease the total number of authorized Fire Captain positions from seventy-eight (78) to seventy-seven (77) and the total number of authorized Fire Lieutenant positions from one hundred two (102) to one hun- dred one (101). DISCUSSION• The Fire Department's FY 90-91 budget includes a reduction of thirty (30) Civil Service positions of various ranks, seventeen of which were eliminated October 1, 1990, and thirteen to be deleted during the first quarter of the fiscal ear through normal attrition. City Council recently approved M&C G-8844 October 2, 1990) deleting two Captain positions of the total thirteen positions to be deleted. There is currently one Fire Captain vacancy and one Fire Lieutenant vacancy in the Fire Department with no Civil Service eligi- bility list in effect for the positions. On July 17, 1990, City Council approved M&C G-8733 adopting an ordinance (Ordinance No. 10640) deleting two Calptain positions that were vacant at that time and stating the Fire Department's intent to delete the thirty (30) addi- tional Civil Service positions. Such intent was declared so as to negate any employee expectancy for promotion into the positions as they become vacant.
