HomeMy WebLinkAboutOrdinance 10706 ORDINANCE NO. 9 ( 0 AN ORDINANCE VACATING, ABANDONING, CLOSING, AND EXTIN- GUISHING A PORTION OF CONNER AVENUE LOCATED ADJACENT TO LOT 7-C, DUNLAP'S ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND(S); REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the portion of Conner Avenue (150 feet) located adjacent to Lot 7-C, Dunlap's Addition to the City of Fort Worth, the plat of which is recorded in Volume 388M, Page 175, of the Plat Records of Tarrant County, Texas, be and the same is vacated, abandoned, and permanently closed and extinguished. SECTION 2. That the fee to the land in the above described vacated 4 street right-of-way is hereby released and shall revert to the adjacent owner as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities and drainage requirements as necessary. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. X b, SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. AVENUE @ AVENUE L (V-90-17) Ty SERVICES a 7 RECOMMENDATION: -, .J t is recommended that the City Council adopt an ordinance vacating a portion of Conner Avenue from the south right-of-way line of Avenue L located at the southeast corner of Lot 7-C, Dunlap's Addition, and going north a total dis- tance of 150' to the north property line of Lot 7-C, Dunlap's Addition. The subject street vacation is located adjacent to Lot 7-C, Dunlap's Addition as recorded in Vol. 388M, Page 175, and Block 113-RA, Polytechnic Heights Addi- tion, as recorded in Vol. 388-28, Page 199, and Lot 13, Block 92, Polytechnic _ Heights Addition, as recorded in Vol. 63, Page 109, P.R.T.C.T., as recom- mended by the City Plan Commission. DISCUSSION: St. Teresa's Home operated by the Catholic Diocese of Fort Worth and Volun- teers of America Northern Texas, Inc., owner of all abutting property, has requested that the City vacate the above-described street right-of-way as shown on the attached map. The subject street, acquired by dedication is not open on the ground but does contain electric and telephone utility facilities. The subject vacation request has been proposed in order to replat the vacated right-of-way with the adjoining lot to expand the building area for additional structures for St. Teresa's Home. All necessary access, drainage and utility easement will be retained. The Land Agent for the City of Fort Worth has determined that a $100.00 con- sideration fee will satisfy the interest of the City in this public right-of- way. Reviewing City departments and private utility companies have raised no objection to this request. A satisfactory replat has been submitted.
