ORDINANCE NO. ~V~~O AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING A UTILITY EASEMENT LOCATED IN LOTS C THROUGH M, BURTON ACRES ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXA5: SECTION 1. THAT the 5-foot wide by 686.3 foot long utility easement located within and adjacent to the south property line of Lots C through M, Burton Acres Addition, as shown on plat recorded in Volume 388-W, Page 19, Plat Records, Tarrant County, Texas, be and the same is vacated, abandoned and permanently closed and extinguished as a utility easement. SECTION 2. That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adja- cent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. STREET BETWEEN CASTLEMAN STREET AND SAN ROSE DRIVE (V-89-43) RECOMMENDATION It is recommended that the City Council adopt an ordinance vacating a 5' wide x 686.3' long utility easement located adjacent to the south property line of Lots "C" through "M", Block 16, Burton Acres Addition, as recorded in Volume 388-W, Page 19, P.R.T.C.T. DISCUSSION Mr. Gerry Curtis, surveyor representing the Fort Worth Independent School District and owner of all adjacent property, has requested that the City vacate the above described utility easement, as delineated on the attached map. The subject easement, acquired by dedication, contains a sanitary sewer line which is abandoned and changed to a private sanitary sewer line. The subject vacation is being made in order to utilize the vacated easement as part of the development of the subject property by the School District. The Director of Real Property Management has determined that no consideration fee is required to satisfy the City of Fort Worth's interest in this request. Reviewing City departments and private utility companies have raised no objection to this request. A satisfactory replat has been submitted.
