HomeMy WebLinkAboutOrdinance 10529G 4 ~i a ORDINANCE N0. ~~~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTINGUISHING PORTIONS OF NORTHEAST 34TH AND NORTHEAST 35TH STREETS AND AN ALLEY RIGHT-OF-WAY, AS MORE SPE- CIFICALLY DESCRIBED HEREIN, LOCATED WITHIN `'rHE FOSTEPCO HEIGHTS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following public street and alley rights-of-way are hereby vacated, abandoned, and permanently closed and extin- guished: (1) Portions of Northeast 34th and Northeast 35th Street extending from the Chicago Rock Island right-of-way to North Grove Street; and (2) The fifteen {15) foot wide north/south alley located between Northeast 34th Street and Northeast 35th Street, and located within Block 44, Fostepco Heights Addition to the City of Fort Worth, Texas, the plat of which is recorded in Volume 204-A, Page 126, of the Deed Records, Tarrant County, Texas; all as shown on the map marked Exhibit "A" attached hereto and incorporated herein. SECTION 2. That the fee to the land in the above-described vacated pub- lic street rights-of-way and alley right-of-way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. PAGE 2-20-90 **PZ-1573 FOSTEPCO HEIGHTS BLOCKS 31 44 & 57 ~ 1 N ~a tof OF NORTH GROVE STREET (V-88-20) tV CES r 2 RECOMMENDATION: D INISTRAt10N.11 It is recommended that the City Council adopt an ordinance vacating a portion "g'R't~`P"'Northeast 34th and 35th Streets between the Chicago and Rock Island ~• Railroad and North Grove Street and a 15' wide x 600' long alley located between Northeast 34th and 35th Streets, Blocks 31, 44, and 57 , Fostepco . Heights Addition, as recorded in Volume 204-A, Page 126, Deed Records, Tarrant County, Texas, as recommended by the City Plan Commission. DISCUSSION: Mr. Donnis Hatchett, consultant, representing all adjacent property owners, has requested that the City vacate the above described streets and alley, as delineated on the attached map. The subject streets and alley, acquired by dedication, contain a sanitary sewer line and a natural gas line. Acceptable arrangements have been made with the utility service providers for the dedication of easements for the existing utility service lines. The subject vacation is being made in order to utilize the vacated streets and alley as part of the development of the subject property. The Director of Real Property Management has determined that no consideration fee is required to satisfy the City of Fort Worth's interest in this request because of dedication of right-of-way for the reconstruction of Grove Street.
