HomeMy WebLinkAboutOrdinance 10632ORDINANCE NO. lO / AN ORDINANCE AMENDING THE FIRE CODE OF THE CITY OF FORT WORTH, CODIFIED AS -CHAPTER 13, ARTICLE I, OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, BY AMENDING APPENDIX VII-B CONCERNING THE REQUIREMENTS FOR INSTALLATION CERTIFICATES AND BY INCREASING THE INSPEC- TION AND TESTING FEES; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING PENALTIES FOR VIOLA- TIONS; PROVIDING FOR SEVERABILITY; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; + PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 13-2 of the Code of the City of Fort Worth (1986), as amended, is hereby amended by changing Appendix VII-B 2, Installation Certificate Required, EXCEPTIONS 1. (b), to read as follows: "(b) Not more than two (2) alarm initiating devices are installed or relocated, or" SECTION 2. That Section 13-2 of the Code of the City of Fort Worth (1986), as amended, is hereby amended by revising all of 5., "Inspection and Testing Fees", in Appendix VII-B to read as follows: "5. Inspection and Testing Fees "A. Upon application for an installation certificate, the applicant shall be required to pay all inspec- tion fees associated with the installation or tenant finish work as specified in this section or agree to have such fees posted in the prearranged billing account with the bureau of fire prevention to be billed monthly. Account balances shall be required to be paid within twenty-one (21) days of the billing date. Fire alarm systems with more than two (2) automatic detection devices, fire sprinkler systems or special agent systems shall be changed according to the following fee sched- ule: Sprinkler Installation Less than 20 heads $75 20 heads or more $100 Additional floors $40/flr Tenant finish $60 Alarm installation 2-5 initiating devices $60 6 or more initiating devices $90 Additional floors $40/flr Standpipe testing New: 1-3 risers $250/bldg 4 or more risers $400/bldg Existing (required once every $150/bldg years) Other extinguishing agent Pre-engineered systems $60 Other systems $120 Bottle charge (first line bottles $20/btl only) Additional tests $30/test Re-review of approved plans $50 Fire pump: $150 00 for installation or testing. Atrium smoke control systems: $250 00 B Fees specified in subparagraph A, above, will be doubled if a contractor starts installation or tenant finish work without a valid installation certificate. C. An additional test fee of fifty dollars ($50.00) shall be charged to the fire protection system contractor for failure to correct system defi- ciencies for which the fire protection system con- tractor is responsible which have been cited on a construction plans evaluation report (FD 890) or a fire protection system test report (FD 880) by the subsequent resubmittal or inspection date listed thereon. SECTION 3. This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth (1986), as amended, except where the provisions of this ordinance are in 2 direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. Former Chapter 13 of the Code, as amended is expressly superseded by the terms of this Chapter SECTION 4 It shall be unlawful for any person to erect, construct, enlarge, alter, repair, move, improve, convert, demolish, equip, use, occupy, or maintain any building or structure in the City or cause the same to be done contrary to or in violation of any of the provisions of this Code. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Code shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 5. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, para- graphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in 3 this ordinance of any such unconstitutional phrase, clause, sen- tence, paragraph or section. SECTION 6. All rights and remedies of the City of Fort worth, Texas, are expressly saved as to any and all violations of the provi- sions of Chapter 13 of the Code of the City of Fort Worth, as amended, or any other ordinance affecting construction and fire safety, which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts SECTION 7. This ordinance constitutes a digest and revision of the Fire Code of the City of Fort Worth, as provided in Section 2, Chapter XXV, and Section 9, Chapter XXVII, of the Charter of the City of Fort Worth. The City Secretary of the City of Fort Worth, Texas, is hereby authorized to publish this ordinance in pamphlet form for general distribution among the public, and the operative provisions of this ordinance, as so published, shall be admissible in evidence in all courts without further proof than the production thereof, as provided in Chapter XXV, Section 3, of the Charter of the City of Fort Worth, Texas. SECTION 8. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the 4 caption, ,penalty clause and effective date in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 9. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effec- tive date of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013, Texas Local Government Code. SECTION 10 This ordinance shall be in full force and effect thirty (30) days after its passage and publication, and it is so ordained. Approve the attached ordinances increasing certain existing fees for Police, Fire, and Transportation and Public Works as indicated in the discussion section below. DISCUSSION: During the Pre-Council meeting on April 4, 1990 City staff presented Informal Report No. 7456, User Fee Increase Recommendations, to City Council. The City Council agreed to increase the fees as shown in the report; thereby increasing revenues to the General Fund. Approva'1 of this Mayor and Council Communication will effect that decision.
