ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 34, ARTICLE V, OF THE
CODE OF THE CITY OF FORT WORTH, TEXAS (1986}, AS
AMENDED, WHICH CHAPTER REGULATES WRECKERS, BY AMENDING
SECTIONS 34-182 AND 34-196 TO INCREASE CERTAIN FEES;
PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A PENAL CLAUSE; AND NAMING OF AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That Section 34-182 of Chapter 34 of the Code of the City of
Fort worth, Texas (1964), as amended, be, and the same is hereby,
amended to read as follows:
"Sec. 34-182. Fees.
(a) The annual fees applicable to this article are
as follows:
(1) Wrecker business license..... .......$200.00
(2} Rotation list service charge.. ......$250.00
(3) Inspection fee (per wrecker).........$ 30.00
(4) Driver permit fee (per driver).......$ 50.00
(5} Letters of authorization filing fees
(annual renewal not required)......$ 30.00
(b) No fee payments shall be returnable"
SECTION 2.

That Section 34-196 of Chapter, 34 of the Code of the City of
Fort Worth (1964), as amended, be;' and the same is hereby,
amended to read as follows:
"Sec. 34-196. Storage and pound fees.
The City shall charge a storage fee of Ten
Dollars ($10.00) per day with each day computed on a
basis of twenty-four (24) hours, commencing with the
time the vehicle is placed in storage. This fee of
Ten Dollars ($10.00) will be charged for the first
ten (10) days such vehicle is in storage. Commencing
with the eleventh twenty-four-hour period of storage,
the City will charge a storage fee of Fifteen Dollars
($15.00) per day with each day computed on a basis of
twenty-four (24) hours. This rate is to be doubled
for vehicles weighing in excess of two (2) tons. The
City shall also charge an impound fee of Ten Dollars
($10.00) per impoundment."
SECTION 3.
That this ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth (1986), as
amended, affecting wreckers, except where the provisions of this
ordinance are in direct conflict with the provisions of such ordi-
nances and such Code, in which event conflicting provisions of
such ordinances and such Code are hereby repealed
SECTION 4.
That all rights or remedies of the City of Fort Worth,
Texas, are expressly saved as to any and all violations of the
provisions of Chapter 34 of the Code of the City of Fort Worth
(1986), as amended, and of any other ordinances affecting
wreckers which have accrued at the time of the effective date of
this ordinance; and as to such accrued violations and all pending
litigation, both civil and criminal, whether pending in court or
not, under such chapter or other ordinances, same shall not be
affected by this ordinance but may be prosecuted until final dis-
position by the courts.
SECTION 5.
That it is hereby declared to be the intention of the City
Council of the City of Fort Worth, texas, that the sections, para-

graphs, sentences, clauses and phrases of this ordinance are
severable, and, if any section, paragraph, sentence, clause or
phrase of this ordinance shall be declared void, ineffective or
unconstitutional by the valid judgment or final decree of a court
of competent jurisdiction, such voidness, ineffectiveness or
unconstitutionality shall not affect any of the remaining
sections, paragraphs, sentences, clauses or phrases of this
ordinance since the same would have been enacted by the City
Council without the incorporation herein of any such void,
ineffective or unconstitutional section, paragraph, sentence,
clause or phrase.
SECTION 6.
That any person violating any of the provisions of this ordi-
nance shall be deemed guilty of a misdemeanor and each such per-
son shall be deemed guilty of a separate offense for each day or
portion thereof during which any violation of any of the provi-
sions of this ordinance is committed, continued or permitted, and
each violation shall be punishable by a fine not to exceed Two
Hundred Dollars ($200.00).
SECTION 7.
That the City Secretary of the City of Fort Worth, Texas, is
hereby directed to publish the caption, penalty clause and effec-
tive date of this ordinance for two (2) days in the official
newspaper of the City of Fort Worth, Texas, as authorized by
Section 52.013, Texas Local Government Code.

SECTION 8.
That this ordinance shall be in full force and effect from
and after the date of its passage and publication as required by
law, and it is so ordained.

RECOMMENDATION:
It is recommended that the City Council:
1. Approve the attached ordinances increasing certain existing fees for
Police, Fire, and Transportation and Public Works as indicated in the
discussion section below.
DISCUSSION:
During the Pre-Council meeting on April 4, 1990 City staff presented Informal
Report No. 7456, User Fee Increase Recommendations, to City Council. The
City Council agreed to increase the fees as shown in the report; thereby
increasing revenues to the General Fund. Approval of this Mayor and Council
Communication will effect that decision. The following are fees that have
previously been established by ordinance and are recommended to be increased
to the following rates:
FIRE
Sprinkler Installation
Less than 20 heads $ 75
20 heads or more $100
Additional floors $ 40/flr
Tenant finish $ 60
Alarm Installation
2-5 initiating devices $ 60
6 or more initiating devices $ 90
Additional floors $ 40/flr
Standpipe Testing
New:

Existing (required once every 5 years) $150/bldg
Other Extinguishing Agent
Pre-engineered systems $ 60
