HomeMy WebLinkAboutOrdinance 10734. ,,` ORDINANCE N0. ~`l.~ AN ORDINANCE AMENDING CHAPTER 20 ("LICENSES AND MIS- CELLANEOUS BUSINESS REGULATIONS") OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1986), AS AMENDED, BY AMENDING ARTICLE II ("AMUSEMENTS"), DIVISION 4 ("DANCE HALLS"), SECTION 20-67 ("SAME - DURATION; REFUND POLICY"), PROVIDING THAT DANCE HALL LICENSES SHALL BE VALID FOR A PERIOD OF ONE YEAR FROM THE DATE OF ISSUE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR ENGROSSMENT AND ENGROSSMENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 THAT Section 20-67 of Chapter 20 of the Code of the City of Fort Worth, Texas (1986), as amended, is amended and, after such amendment, shall read as follows: "Sec. 20-67. Same - Duration; refund policy. "All dance hall licenses shall be valid for a period of one year from the date of issue. There shall be no refund of any license fee paid under this divi- sion for any cause whatsoever." SECTION 2 This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, Texas (1986), f'as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, para- graphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sen- ' tence, paragraph or section. SECTION 4. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provi- sions of Chapter 20 of the Code of the City of Fort Worth, Texas {1986), as amended, which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 5. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the cap- 2 `,. _. ~. tion and Sections 1 and 6 in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. RECOMMENDATION: It is recommended that the City Council approve the attached ordinances to amend Section 20-67 and Section 20-96 of the Code of the City of Fort Worth to provide for one year pool hall and dance hall licenses valid from the date of issuance. BACKGROUND: Currently, the City Code provides for dance hall and pool hall licenses based on the calendar year.. Issuance during the calendar year requires pro-ration of the fee and additional record keeping and creates an uneven work flow at calendar year end. By modifying Section 20-67 (dance halls) and Section 20-96 (pool halls) of the Code for issuance of one year licenses from date of issue, record keeping would be simplified without modifying the duration of the license period. FINANCING: Not applicable. COLLECTION RESPONSIBILITY: The Revenue Collection Section of Finance Department is responsible for collection of these licenses.
